    Abstract:

    On 2 July 1999, the Queensland Court of Appeal handed down its decision in Australian Granites Ltd v Eisenwerk Hensel Bayreuth Dipl-Ing Burkhardt GmbH. The case, which concerned the legal framework governing an international commercial arbitration, became instantly infamous for establishing the so-called Eisenwerk principle, pursuant to which the adoption of arbitration rules was said to constitute a displacement of the UNCITRAL Model Law on International Commercial Arbitration. The decision was not well received in arbitration circles, with a number of academic commentaries criticising the approach taken in Eisenwerk to the interactions and relationships between the curial law governing an arbitration, and procedural rules which may be adopted for the purposes of conducting an arbitration.More than 10 years later, in August 2010, two different courts in two different Australian states had occasion to review the Eisenwerk principle. On 11 August 2010, the New South Wales Supreme Court handed down its decision in Cargill International SA v Peabody Australia Mining Ltd. Just nine days later, the Queensland Court of Appeal itself reconsidered Eisenwerk in Wagners Nouvelle Caledonie Sarl v Vale Inco Nouvelle Caledonie SAS.This case note comprises four main parts. In Part II, the legal background to the two recent decisions (that background consisting of the Eisenwerk case and Australia’s international commercial arbitration legislation) is reviewed. In Parts III and IV, Cargill International SA and Wagners respectively are examined. Finally, in Part V, the current status of Eisenwerk in Australian law (in light of these two decisions and recent legislative reforms) is considered. Both decisions are notable not only because of the controversy surrounding the original Eisenwerk decision, but also because of the differing approach each takes to the Eisenwerk principle and the place that principle now occupies within an amended legislative regime for international commercial arbitration in Australia.

    BACKGROUND The US Centers for Disease Control and Prevention (CDC) helps protect the health and safety of all people. The workplace can be used to reach millions of workers and their families with programs, policies, and benefits that promote health. We describe a CDC-led project to build Cargill's workplace health promotion capacity and identify the importance of a company liaison in the public-private relationship. CONTEXT The project goals were to engage diverse Cargill personnel, conduct a workplace health assessment, aid in the development of a workplace health program action plan, and develop Cargill's internal capacity using knowledge and skill-building. METHODS CDC partnered with Cargill on a workplace health promotion project to build Cargill's capacity. A multicomponent assessment was conducted to determine priority employee health issues, stakeholder meetings were held to engage and educate Cargill management and employees, and technical assistance was provided regularly between CDC and Cargill. CONSEQUENCES Identifying a company liaison to work with an external assessment team is critical to building capacity for a successful workplace health project. This relationship creates an understanding of company culture and operations, facilitates access to key stakeholders and data, and provides opportunities to enhance capacity and sustainability. INTERPRETATION Employers undertaking workplace health promotion projects should identify a senior-level person to serve as the company health leader or liaison and who can devote the time necessary to build trusting relationships with partners to ensure project success. This person is valuable in facilitating communications, data collection, logistical support, troubleshooting, and influencing employer workplace health practices.

    Resistance categories (antibiosis and tolerance) of four sorghum (Sorghum bicolor (L.) Moench) hybrids to biotype I greenbug, Schizaphis graminum (Rondani), were determined in environmental growth chamber and field studies. Greenbug weight and fecundity were lower on ‘Cargill 607E’ compared with ‘Cargill 797’. Percentage of leaf damage area was significantly less on two resistant hybrids (Cargill 607E and Cargill 797) after a 14-d greenbug feeding period compared to two susceptible hybrids (‘Golden Harvest 510B’ and Garst 5715). In growth chamber studies on sorghum seedlings, ‘Cargill 607E’ and ‘Cargill 797’ reduced greenbug weight significantly compared with ‘Golden Harvest 510B’ and ‘Garst 5715’. Greenbug weight was 2.9 mg/25 greenbugs on ‘Cargill 607E’, 3.1 mg/25 greenbugs on ‘Cargill 797’, 3.9 mg/25 greenbugs on ‘Golden Harvest 510B’, and 4.8 mg/25 greenbugs on ‘Garst 5715’. On field grown sorghum plants, ‘Cargill 797’ did not reduce greenbug growth compared with ‘Golden Harvest 510B’. ‘Cargill 607E’ had a negative impact on weight of greenbugs. Greenbug weight was 7.9 mg/25 greenbugs on ‘Cargill 607E’, 9.2 mg/25 greenbugs on ‘Cargill 797’, and 10.0 mg/25 greenbugs on ‘Golden Harvest 510B’. ‘Cargill 607E’ and ‘Cargill 797’ were resistant to biotype I greenbugs compared with susceptible ‘Golden Harvest 510B’ and ‘Garst 5715’. Antibiosis was confirmed as the primary category of resistance in ‘Cargill 607E.’ ‘Cargill 797’ was primarily tolerant but may have some level of antibiosis, because smaller greenbugs developed in some of the studies

    Interactions of the parasitoid Lysiphlebus testaceipes (Cresson) and the greenbug, Schizaphis graminum (Rondani), on greenbug-resistant ‘Cargill 607E’ (antibiosis), ‘Cargill 797’ (primarily tolerance), and -susceptible ‘Golden Harvest 510B’ sorghum, Sorghum bicolor (L.) Moench, were tested using three levels of biotype I greenbug infestation. The parasitoid infestation rate was 0.5 female and 1.0 male L. testaceipes per plant. For all three greenbug infestation levels, the parasitoid brought the greenbug under control (i.e., prevented the greenbugs from killing the plants) on both resistant hybrids, but it did not prevent heavy leaf damage at the higher greenbug infestation rates. At the low greenbug infestation rate (50 greenbugs per resistant plant when parasitoids were introduced), greenbugs damaged 5 and 18% of the total leaf area on ‘Cargill 797’ and ‘Cargill 607E’, respectively, before greenbugs were eliminated. Leaf damage was higher for the intermediate infestation study (120 greenbugs per plant), 21% and 30% leaf area were damaged on the resistant sorghum hybrids ‘Cargill 797’ and ‘Cargill 607E’, respectively. At the high greenbug infestation rate (300 greenbugs per plant), heavy damage occurred: 61% on ‘Cargill 607E’ and 75% on ‘Cargill 797’. The parasitoids did not control greenbugs on the susceptible sorghum hybrid ’Golden Harvest 510B’. L. testaceipes provided comparable control on both greenbug-resistant hybrids. This study supports previous studies indicating that L. testaceipes is effective in controlling greenbugs on sorghum with antibiosis resistance to greenbugs.
