Asi mismo, la regulacion incluyo la causal de aprehension por la introduccion al territorio aduanero nacional de mercancias cuyo consignatario, destinatario, declarante o importador sea una persona inexistente. Esta causal genera dudas a los usuarios sobre lo que se entendia por persona inexistente, por lo cual el presente articulo busca determinar el contenido juridico de dicho concepto. English Abstract: With the issuance of Decree 390 of 2016 “New Customs Regulation”, a possible solution was proposed certain problems of Decree 2685 of 1999, some as: the apprehensions that were made for insignificant errors in the descriptions of the goods, among others. Likewise, the regulation included the grounds for apprehension for the introduction into the national customs territory of goods whose Consignee, Consignee, declarant or importer is a non-existent person. This causal generates doubts to the users about what was understood by “non-existent person”, for which the present article seeks to determine the legal content of said concept.

A Time-Based Policy for Empty Container Management by Consignees
Production and Operations Management, 2019Co-Authors: Benjamin Legros, Yann Bouchery, Jan C FransooAbstract:Despite the many advantages of containerization for goods transportation, the management of empty containers is a major disadvantage, driving costly repositioning operations. We investigate the potential for Consignees to manage an inventory of empty containers at their location so as to enable direct reuse of these containers by consignors located in the surroundings. One difficulty is that the detention fees imposed by shipping companies under merchant haulage are nonlinear. Moreover, cleaning and related activities might be necessary if the Consignee keeps some empties. These difficulties incentivize Consignees to immediately return containers to the sea terminal. Contrary to this practice, we show that managing containers via time‐based threshold policies can save costs. Without cleaning costs, we prove that a time‐based policy with a timeout return time is optimal. We next develop a policy improvement approach to include the cleaning costs in the analysis. This results in a two‐thresholds time‐based policy where the two time thresholds control the admission into and rejection out of the inventory. We next analyze the impact of this proactive management on the level of direct container reuse. This practice enables a high level of direct reuse. It also reduces container repositioning costs. Yet, the incentive to implement our policy varies a lot from one setting to another. In particular, low cleaning costs or high repositioning costs lead to significant costs improvement when implementing our policy. Finally, we further explore if the incentive could be made stronger by modifying the structure and/or purpose of the detention costs.

'Universidad Inca Garcilaso de la Vega', 2017Co-Authors: Rodríguez Galindo, Nilda RoxanaAbstract:La primera cuestión planteada en la presente tesis, está orientada a determinar si procede o no la devolución al país de origen de un envío objeto de compraventa internacional, con trámite de nacionalización iniciada pero no concluida dentro del plazo de conservación previsto en las Actas de la Unión Postal Universal; ya que por un lado, el artículo 5 del Convenio Postal Universal establece la devolución (reembarque) del envío al país de origen cuando éste no haya sido entregado al destinatario (consignatario) por cualquier motivo, y por otro lado, el literal b) del artículo 178 de la Ley General de Aduanas de nuestro país establece que procede el abandono legal de la mercancía en caso de que no se concluya con el trámite de nacionalización del envío.The first question raised in this thesis, is aimed at determining whether or not the return to the country of origin of a shipment subject to international sale, with nationalization procedure initiated but not completed within the period of conservation provided in the Acts of the Universal Postal Union; since on the one hand, Article 5 of the Universal Postal Convention establishes the return of the shipment (re-shipment) to the country of origin when it has not been delivered to the recipient (Consignee) for any reason, and on the other hand, letter b) of the Article 178 of the General Law of Customs of our country establishes that the legal abandonment of the merchandise proceeds in case it is not concluded with the procedure of nationalization of the shipment. De ahí que no resulte obvio que aquél pueda hacer valer en su propio nombre los derechos que emanen de dicho contrato, y que haya de buscarse el fundamento en virtud del cual se le permite a una persona que no ha participado en la celebración del contrato invocar sus cláusulas para reclamar el cumplimiento de las obligaciones del porteador. A tal efecto, a lo largo de la tesis se abordan distintos temas de especial relevancia con respecto a la posición jurídica del destinatario. El primer tema se dedica a estudiar la teoría general del contrato a favor de tercero; el segundo se trata del contrato de transporte; y por último, se analiza el tema que se ocupa de los derechos y obligaciones del destinatario en cuanto tercero ajeno al contrato frente al porteador.The Consignee is a third party outside the contract of carriage concluded between the carrier and the shipper.
