    This chapter considers data management and information governance in detail, from the perspectives of each of the key members of the team: in-house counsel, the litigator, the Forensic Consultant, and IT personnel. The chapter follows the creation and management of the organization’s data inventory (based on the data map), with special emphasis on data destruction policies and such policies’ interaction with the litigation hold and subsequent preservation actions. It also discusses regulatory requirements (including PII—personally identifiable information) and industry norms that can affect data destruction and preservation activities.

    This chapter analyzes information governance and system structural information in the ESI preservation context. In order to understand and use the system’s structural information, the organization must institute and then maintain accurate data maps. This process must be controlled by individuals who are trained in information governance protocols. The in-house IT personnel in charge of IG as well as the computer Forensic Consultant on the team need proper certification in various Forensic skills in order to carry out appropriate data collection and preservation strategies discussed in this chapter that will withstand scrutiny during litigation. Various certification organizations for cyber Forensics professionals are identified in this chapter.
