Journal of Yanbian University, 2009Co-Authors: Zhang Dian-junAbstract:Accommodating and supplementary provisions of Marriage Law respect and protect Marriage customs of ethnic minorities,and maintain the rights and interests of ethnic minorities in Marriage and family.Accommodating provisions change certain provisions and the content of Marriage Law,and it takes the forms of autonomous regulations or separate regulations.Extended interpretation should be done to accommodation to include supplementary provisions.It can be enacted by legislation or judicial interpretations.Not only should minority customary Law be paid more attention but also the accommodating provisions with it should be enriched and improved.The Supreme Court judicial interpretation on Marriage Law can also be accommodated according to relevant Laws and jurisprudence.In order to better understand and abide by the Marriage Law and its accommodating provisions,education of national Law should be implemented efficiently.

Journal of Shandong Institute of Business and Technology, 2008Co-Authors: Yu Dong-huiAbstract:The system of visitation right is a newly established system in Marriage Law of the People's Republic of China in 2001,which has filled the legislation gap and is great progress of Marriage and family legislation.Starting with the analysis of the implication of visitation right,this paper conducts comment and analyzes the rules on the subject,suspension and enforcement of visitation right in China,proposes the following countermeasures: the principle which children should be the best interests,appropriately expand the main scope of the rights and obligations of visitation right,clarify the case of suspension of visitation right,regulate the basic principle of visitation right and increase relief measures of visitation right,to further perfect the visitation right system in China.
