After a short reminder of the different rights of appeal in France, we describe how Medical appeals function in other European countries. Next, we give the details of how the evaluation of claims of bodily damage works, a process in which every physician may be called upon to participate several times in a career, either as the defendant, or as a Medical counselor, or as an Expert. The goal of this update is to understand the different compensation appeal circuits available to patients and help the surgeon demystify and dedramatize the situation while preparing for the Medical Expert witness testimony. All such testimony reports, via whatever appeal circuit, follow a similar procedure, even if they are not exactly identical.

However, the defendant must perceive and use this encounter as an opportunity to express his/her viewpoint on the Medical accident. This article provides the principal juridical rules that govern the Medical Expert witness testimony that must be known, as well as some practical advice on how the Medical Expert witness testimony evolves and how to protect oneself from the complaints, In order to enable the defendant to best prepare for this confrontation between the involved parties.

Medical Expert system for low back pain management: design issues and conflict resolution with Bayesian network

Mandal, Subrata GoswamiAbstract:The paper focuses on the development of a reliable Medical Expert system for diagnosis of low back pain (LBP) by proposing an efficient frame-based knowledge representation scheme and a suitable resolution logic with conflicts in outcomes being resolved using Bayesian network. Considering that LBP is classified into many diseases based on different pain generators, the proposed methodology infers non-conflicting LBP diseases sorted according to their chances of occurrence. A satisfactory clinical efficacy (average relative error − 0.09, recall 74.44%, precision 76.67%, accuracy 71.11%, and F 1-score 73.88%) of the proposed methodology has been found after validating the design with empirically selected thirty LBP patient cases. Constraining that an inferred disease having chance of occurrence, prior to pathological investigations, below 0.75 (as set by four pain specialists) is not accepted clinically; the design can correctly identify, on average, 74.44% of actual diagnosis; and 76.67% of inferred diagnosis is included in actual diagnosis. With the predicted chance of occurrence being lower than 0.75 by a fraction of 0.09 on average, the proposed design performs well for 73.88% cases detecting 71.11% inferred outcomes as accurate. The design offers homogeneity to the actual outcomes, with the chi-squared static being calculated as 11.08 having 12 as degree of freedom. Graphical abstract

Addressing Design Issues in Medical Expert System for Low Back Pain Management: Knowledge Representation, Inference Mechanism, and Conflict Resolution Using Bayesian Network.

Mandal, Subrata GoswamiAbstract:Aiming at developing a Medical Expert system for low back pain management, the paper proposes an efficient knowledge representation scheme using frame data structures, and also derives a reliable resolution logic through Bayesian Network. When a patient comes to the intended Expert system for diagnosis, the proposed inference engine outputs a number of probable diseases in sorted order, with each disease being associated with a numeric measure to indicate its possibility of occurrence. When two or more diseases in the list have the same or closer possibility of occurrence, Bayesian Network is used for conflict resolution. The proposed scheme has been validated with cases of empirically selected thirty patients. Considering the expected value 0.75 as level of acceptance, the proposed system offers the diagnostic inference with the standard deviation of 0.029. The computational value of Chi-Squared test has been obtained as 11.08 with 12 degree of freedom, implying that the derived results from the designed system conform the homogeneity with the expected outcomes. Prior to any clinical investigations on the selected low back pain patients, the accuracy level (average) of 73.89% has been achieved by the proposed system, which is quite close to the expected clinical accuracy level of 75%.

Scheme for Unstructured Knowledge Representation in Medical Expert System for Low Back Pain Management

Knowledge about a patient is stored in the Expert system in terms of clinical records which should contain information about multiple visits of the patient. During each visit, several conversations are made between the patient and the consulting physician. These conversations, being unstructured in nature, cannot be stored in the computer using available structured knowledge representation schemes. So, we propose a recursive frame-based structure for representing clinical records. The frames related to a patient collectively form a frame system, where one frame may point to other frames. The proposed representation scheme is complete, consistent, and free from redundancy.

Rough set based lattice structure for knowledge representation in Medical Expert systems: low back pain management case study

Mandal, Subrata GoswamiAbstract:The aim of Medical knowledge representation is to capture the detailed domain knowledge in a clinically efficient manner and to offer a reliable resolution with the acquired knowledge. The knowledge base to be used by a Medical Expert system should allow incremental growth with inclusion of updated knowledge over the time. As knowledge are gathered from a variety of knowledge sources by different knowledge engineers, the problem of redundancy is an important concern here due to increased processing time of knowledge and occupancy of large computational storage to accommodate all the gathered knowledge. Also there may exist many inconsistent knowledge in the knowledge base. In this paper, we have proposed a rough set based lattice structure for knowledge representation in Medical Expert systems which overcomes the problem of redundancy and inconsistency in knowledge and offers computational efficiency with respect to both time and space. We have also generated an optimal set of decision rules that would be used directly by the inference engine. The reliability of each rule has been measured using a new metric called credibility factor, and the certainty and coverage factors of a decision rule have been re-defined. With a set of decisions rules arranged in descending order according to their reliability measures, the Medical Expert system will consider the highly reliable and certain rules at first, then it would search for the possible and uncertain rules at later stage, if recommended by physicians. The proposed knowledge representation technique has been illustrated using an example from the domain of low back pain. The proposed scheme ensures completeness, consistency, integrity, non-redundancy, and ease of access.

an approximate reasoning using probability possibility transformation for Medical Expert systems

We describe a transformation between the probabilistic logic and the possibilistic logic as a suitable reasoning engine for Medical Expert systems. Further more, a structure of the system including knowledge base and inference of the system is proposed. An example of performance of the system testing the knowledge base on pulmonary tuberculosis diagnosis is illustrated.

He or she must define a standard of care and opine whether the standard has been breached and whether any perceived injury was caused by the breach. The American College of Obstetricians and Gynecologists (ACOG) ethical guidelines insist that the testimony be objective (free from intentioned distortion) and that the witness not assume an advocacy or partisan role. The ethical and professional boundaries of appropriate Expert testimony as delineated by ACOG are more restrictive than the legal boundaries. Members of ACOG should be held to more restrictive ACOG guidelines and egregious testimony condemned by ACOG. Prospective peer review, increased judicial review, and testimony banks are other examples of methods to improve the quality of Expert witness testimony. Alternatives to litigation for Medical liability disputes and further tort reform might also make the system fairer and more sustainable.
