Report to Law Revision Commission Regarding Recommendations for Changes to California Arbitration Law

It begins by outlining the history of arbitration in California, from its 1961 adoption of the Uniform Arbitration Act, to the 1988 enactment of an international arbitration statute modeled on the UNCITRAL Model Law, to the 1989 enactment of Section 1281.8, which allowed courts to grants provisions remedies to parties involved in arbitration proceedings. It also provides a general overview of the purpose and practice of arbitration law. Then, it provides a chapter-by-chapter analysis the Law Revision Commission's Report: general provisions, enforcement of arbitration agreements, conduct of arbitration proceedings, enforcement of awards, arbitration of medical malpractice, Public Construction Contract arbitration, international commercial arbitration, real estate Contract arbitration, and firefighter and law enforcement arbitration.

E-tendering systems are quite complex since they involve many stages to meet the need of Construction sectors. This paper developed an e-tendering model the Public Construction Contract in Saudi Arabia to improve its efficiency with addresses the dilemma of traditional tendering. Moreover, to assist the development of the proposed e-tendering model, literature review, ten interviews, a focus group, and 52 questionnaire participants are conducted. Therefore, the model allows a Contractor to be involved during the design stage and involved officially during the design process. This feature seeks to minimise the pre-Construction time, reduce the bidder's risks and maximise the quality and transparency of e-tendering. As a result, this paper identified the stage of tender document handling to the bidders is the most affected stage toward more efficient of e-tendering process.

2013Co-Authors: Martin Dutto Giolongo, Carlos BeltranAbstract:Spanish Abstract: El objetivo de este trabajo es analizar, desde una perspectiva economica, las clausulas Contractuales incorporadas en los contratos de Concesion de obra Publica, que tienen por fin incrementar el cumplimiento Contractual y disminuir los costos de transaccion. En particular, se describiran las soluciones Contractuales a los problemas originados en la racionalidad limitada y especificidad de activos. Se recurre para este estudio a la evidencia de un caso de concesion de obra Publica. El analisis revela que en la concesion objeto de estudio se invierte radicalmente el esquema de financiacion de la inversion, respecto al existente en el contrato de obra Publica. Mientras que en esta ultima la financiacion de la inversion estaba en su mayor parte a cargo del Estado, ya que paga lo construido por la empresa generalmente a los treinta dias, en la Concesion la financiacion de inversion esta a cargo usualmente de la empresa, ya que recupera lo invertido recien cuando cobra a los usuarios del servicio. En consecuencia, mientras que en el contrato de obra Publica deberia ser principalmente el Estado el destinatario de salvaguardas para proteger el capital humano generado y financiado por El, en la Concesion deberia ser la empresa la principal destinataria de salvaguardas tanto por la inversion en activos fisicos como humanos.English Abstract: The goal of this paper is to analyze, from an economic perspective, clauses included in Public concession of Construction Contracts, in order to enhance Contractual accomplishment and diminish transaction costs. In particular, Contractual solutions to limited rationality and specificity of assets problems are described. A case of Public concession of Construction Contract is used for this paper as empirical evidence. The analysis reveals that the financing scheme is reversed in the concession, compared to that prevailing in traditional Construction Contract. In the last, financing of investment is mainly in charge of the State, because what is built is paid to the firm generally in thirty days. On the other hand, in concession the financing of the investment is generally supported by the firm, because it is repaid through to charging the users of the infrastructure, in a time much longer than thirty days. So that, due to efficiency reasons, in the traditional Public Contract of Construction should be the State the principal receiver of safeguards to protect human capital generated and financed by him, and in the concession should be the firm the main recipient of safeguard to protect investments in physical as human assets. First, it examines the theoretical nature of the decentralized equilibrium. Then, a comparison of the implications of this equilibrium against a “state–intervened” one is made. Subsequently, actions or policies that government authorities might take to correct them are proposed. Based on the analysis, is considered important to implement policies that enable the development of an attractive Public transport supply.

Discrete-event simulation based performance quantification of web-based and traditional bidder inquiry processes

KirbyAbstract:This paper describes an innovative application of discrete-event simulation to model and evaluate differences in business processes following the introduction of new information technologies. Validated models can be used by offices considering the new technology to calibrate existing work loads and then to predict the expected impact of new information technology on measurable business metrics. Following the introduction of the technology, this model may assist in the real-time verification of user paths incorporated in software support tools. This paper will be of interest to those evaluating the impact of information technology and Public Construction Contract administration.
