Closely related to that, cooperative banks aim to support their members. Both are asked to nance projects as long as economically sustainable. Bank owners grand additional payment that reduce renancing costs. It is argued, that private banks are disadvantaged due to these renancing cost dierentials and competition is distorted. While the strategy set of Public and cooperative banks is xed, private banks are free to choose which strategy they want to apply. In this paper I analyze, whether private banks adopt a dierent lending strategy. If private banks act as hard-nosed bankers as rms become nancially distressed, the probability of market exit should be higher compared to rms nanced by Public or cooperative banks. In order to test this empirically probit models are employed estimating the probability of market exit for rms that became nancially distressed in the years between 2000 and 2005. A Heckman variation of the probit model controls for potential selection bias due to the data generating process. Information on rm'snancing behavior, entrepreneurial education, as well as internal and external factors inuencing a rm's market exit are used as covariates. Results show that rms with a savings or a cooperative bank as their main bank present a lower probability of exiting the market than those with private banks. The reasons for dierent lending strategies remain unclear. A possible explanation would be that private banks adopt stricter rules when rms become nancial distressed. Private banks could ask for additional control rights or rule out renegotiation in general. Private banks credit portfolio risk reduces indirectly if high-risk rms anticipated the behavior of the private banks and self select to Public or cooperative banks. But the approximated credit portfolio risk by bank types, based on rms credit rating scores, indicate that private banks bear higher risk compared to Public or cooperative banks.     O tema do trabalho é proposto pelo Corpo de Fuzileiros, na sequência das missões como Força Nacional Destacada na Lituânia, nos anos de 2018, 2019 e 2021. A projeção e retração de uma unidade de escalão companhia sem recurso a meios navais da Marinha, constitui um caso inédito, sendo um desafio para a Marinha. Em primeiro lugar, procurou-se definir o que é o transporte estratégico, sendo basicamente o transporte de forças militares dos APOE/SPOE para os APOD/SPOD e vice versa, ou seja, é o transporte inter-teatro. Posteriormente, foi realizada uma abordagem da logística de in-house, ou seja, quais os meios que as Forças Armadas Portuguesas dispõem para o transporte estratégico, tendo-se chegado à conclusão que o único meio de transporte estratégico existente é o C-130H da Força Aérea e com capacidades limitadas. Na abordagem de logística outsourcing, realizou-se uma análise das agências internacionais no âmbito da NATO e da União Europeia, dedicadas ao transporte estratégico. No que concerne ao estudo de caso, foi realizada uma análise das duas missões das forças de fuzileiros na Lituânia nos anos de 2018 e 2019, numa perspetiva logística, nomeadamente nas suas cinco fases críticas, com especial incidência nos procedimentos de contratação pública do transporte estratégico. Relativamente ao último capítulo, intitulado de, Modelo de Projeção, Sustentação e Retração de Forças de Fuzileiros, procurou-se em primeiro lugar quantificar em termos financeiros, o gasto com transporte estratégico numa base anual, e com recurso a uma matriz SWOT modificada, encontrar soluções para o transporte estratégico, ao nível macro. Posteriormente dividiram-se as tarefas e funções logísticas, no processo do transporte estratégico, que poderiam ser alocadas a uma célula de mobilidade estratégica na divisão de logística do Comando Naval, deixando para a força de fuzileiros, tarefas e funções logísticas, típicas da unidade de apoio de combate e de RSOM. Abstract: The work title is a proposal from Portuguese Marines Corp, in the sequence of Lithuanian missions in 2018, 2019 and 2021 of Portuguese Marines Forces. The projection and retraction of a company without the support of any ships of Portuguese Navy is unique, and it´s a challenge to the Portuguese Navy. In the first place, it looked for defining strategic transportation, and it was defined basically as the movement of military forces between the APOE/SPOE and APOD/SPOD and vice versa, in another terms, is the inter-theatre transportation. After, it was done an approach to the logistic in-house, in other words, what is the capacity of Portuguese Armed Forces to conduct strategic transportation, and the conclusion was that only the Portuguese Air Force as the capacity, with the aircraft C130-H, and with limited capacity. In the outsourcing logistic approach, it was done an analysis of NATO and European Union international logistic agency, dedicated to strategic transportation. As concern to the case study, it was done an analysis of the two Portuguese Marines missons in Lithuania, in a logistic perspective, concerning is five critical phases, with special incidence in the Public Contract procedure of strategic transportation. In the last chapter, named, The Model of Projection, Support and Retraction of Marines Forces, it looked in the first place to quantify in financial base, the cost of strategic transportation in Portuguese Navy annually, and with resource to a SWOT matrix, find solutions for strategic transportation, at the macro level. Afterwards, the logistic tasks and functions of strategic transportation process was divided into the ones that could be allocated to a cell in logistic division in Naval Command and the logistic tasks and functions to the Marines Forces Support Unit.N/

    Dissertação de Mestrado em Gestão e Políticas PúblicasO modo como a Administração Pública contrata tem vindo a ganhar uma importância acrescida numa sociedade que, cada vez mais, tende a escrutinar, e bem, o modo como os dinheiros públicos são gastos. Considerando o relevo financeiro e o risco associado à contratação pública e às aquisições de bens e serviços, é cada vez mais relevante que os organismos dediquem atenção redobrada ao controlo interno e externo na área das compras. Os desafios são cada vez maiores, a que se associam novas formas de contratação, relacionadas com plataformas eletrónicas, as quais visam transmitir maior simplicidade e transparência, assegurando-se ainda a diminuição de prazos e a desmaterialização dos procedimentos. O Código de Contratos Públicos, privilegiando a via eletrónica para a contratação, procura aumentar a eficiência destes procedimentos. Este trabalho procurou analisar as compras que foram realizadas pela Assembleia da República entre 2015 e 2018 e verificar qual o impacto da contratação eletrónica e da nona versão do Código dos Contratos Públicos, aprovada pelo DL nº 111-B/2017, de 31 de agosto, nos procedimentos por convite, os quais têm uma prevalência significativa na contratação pública nacional. Nesse âmbito, efetuou-se uma abordagem mista, com recurso a pesquisa bibliográfica, análise documental e análise de dados quantitativos, tendo-se também realizado entrevistas a responsáveis na área da contratação pública. Não obstante o inegável sucesso da contratação pública eletrónica, o exemplo da Assembleia da República confirma a existência de um processo de compras muito associado a procedimentos por convite, paradigma que não se alterou significativamente apesar das diversas alterações à legislação já efetuadas. Subsistem, consequentemente, desafios à implementação de uma contratação pública plenamente concorrencial, desmaterializada e que garanta, em permanência, a prossecução do interesse público. Assim, o aumento da concorrência, a desmaterialização e atualização da legislação são problemas que continuam a fragilizar a Contratação Pública Eletrónica em Portugal.The way Public Administration purchases has become a matter of great concern in a society that increasingly examines how Public funds are spent. Considering the financial expression and the risk associated with the acquisition of goods and services, Public organizations must commit special attention to the internal and external control in the purchasing area. Challenges have grown bigger with new ways of Public procurement, associated with e platforms, which aim to deliver simplicity and transparency providing, at the same time, shorter deadlines and the dematerialization of procedures. The Public Contract Code, giving privilege to electronic Contracting, aims to increase the efficiency of these procedures. The goal of this essay is to correlate Public procurement carried out at the Assembly of the RePublic using e-Procurement, the Public Contract Code, namely its ninth version, approved by the Decree-Law number 111-B/2017 of august 31st and direct awards, that still prevail on national Public procurement. In this context, a mixed approach was implemented with the help of bibliographical, documentary and data research, together with interviews to Public procurement officials. Despite the undeniable success of Public e-procurement, the Assembly of the RePublic’s example confirms that procurement procedures are very often associated with direct award, a paradigm that the new legislation has failed to change significantly. Consequently, challenges remain to the implementation of a fully competitive, dematerialized Public procurement, which will ensure the continued pursuit of the Public interest. Therefore, the increase of competitiveness, dematerialisation and legislation updates are problems that still weaken e-procurement in Portugal.N/

    The Technological Change in Health Care Research Network collected unique patient-level data on three procedures for treatment of heart attack patients (catheterization, coronary artery bypass grafts and percutaneous transluminal coronary angioplasty) for 17 countries over a 15-year period to examine the impact of economic and institutional factors on technology adoption. Specific institutional factors are shown to be important to the uptake of these technologies. Health-care systems characterized as Public Contract systems and reimbursement systems have higher adoption rates than Public-integrated health-care systems. Central control of funding of investments is negatively associated with adoption rates and the impact is of the same magnitude as the overall health-care system classification. GDP per capita also has a strong role in initial adoption. The impact of income and institutional characteristics on the utilization rates of the three procedures diminishes over time.     La postura jurisprudencial respecto a la viabilidad del uso de las potestades excepcionales por parte de las entidades estatales exceptuados del Régimen Estatal de Contratación ha sido variable, lo cual ha traído como consecuencia la inseguridad jurídica tanto de dichas entidades, como de los particulares que celebran contratos con estas. El presente artículo desarrolla los conceptos de facultad excepcional, principios de la función administrativa, principio de legalidad y autonomía de voluntad, y contiene un análisis de la jurisprudencia emitida por el Consejo de Estado respecto del ejercicio de la exorbitancia de la terminación unilateral del contrato, de lo cual se concluye que, pese a encontrarse delimitado por la ley para el uso de las entidades sometidas al Régimen de Contratación Pública, en razón al cabal cumplimiento de los fines estatales y el ejercicio de la autonomía de la voluntad, es factible que las entidades exceptuadas de este régimen pueden aplicarlo en sus contratos.The jurisprudential position regarding the viability of the use of exceptional powers by state entities exempted from the State Contracting Regime has been variable, this issue brought legal uncertainty of the related entities and the individuals that enter into Contracts with them. This article develops the concepts of exceptional faculty, principles of the administrative function, principle of legality and party autonomy, and contains an analysis of the jurisprudence issued by the Council of State regarding the exercise of exorbitancy of the unilateral termination of the Contract. In conclusion, despite being delimited by law for the use of entities subject to the Public Contract Regime, due to the full compliance of state purposes and the exercise of party autonomy, it is feasible that state entities exempted from this regime can apply it in their Contracts
