Profiling the Australian Google Consumer: Implications of Search Engine Practices for Consumer Law and Policy

ScardamagliaAbstract:Against the legal backdrop of proceedings against Google in various jurisdictions regarding the layout of its Search Result Page, this article presents the Results of a survey of a representative sample of 1014 Australian consumers, investigating their use of the Internet and specifically Google’s Search engine, and the implications of these findings for consumer law and policy concerning the operation of Search engines. The study is the first of its kind in Australia, despite litigation against Google in this jurisdiction for alleged misleading and deceptive conduct. The survey findings indicate that consumers have a lack of understanding about the operation and origin of the different elements of the Google Search engine. In particular, the findings show particular confusion in relation to the operation and origin of Google’s related vertical services. Such confusion seems to be more pronounced among older respondents and those without higher education qualifications, although the survey revealed some more surprising and unexpected Results in terms of the demographics of confusion. These findings are important for several reasons. Firstly, they identify and point to a gap in consumer knowledge about Google Search that should be addressed, presenting an opportunity for consumer education in this area. Secondly, this reSearch challenges the widely held assumption that the average (Australian) Internet user has a basic understanding about the operation and function of the Google Search engine. Thirdly, the Results leave open the possibility for further proceedings against Google in Australia on the basis of consumer law, the decision in Google v ACCC notwithstanding. This points to the potential for a more active role for consumer law in the digital ecosystem to address problems emanating from large and powerful platform providers such as Google than it previously has occupied.

However, Search engines have recently begun to try to meet people's Search needs directly, providing, for example, flight status information in response to queries that include an airline and a flight number. In this paper, we use large scale query log analysis to explore the challenges a Search engine faces when trying to meet an information need directly in the Search Result Page. We look at how people's interaction behavior changes when inline content is returned, finding that such content can cannibalize clicks from the algorithmic Results. We see that in the absence of interaction behavior, an individual's repeat Search behavior can be useful in understanding the content's value. We also discuss some of the ways user behavior can be used to provide insight into when inline answers might better trigger and what types of additional information might be included in the Results.

Web Search and Data Mining, 2011Co-Authors: Ashok Ponnuswami, Kumaresh Pattabiraman, Ran Giladbachrach, Tapas KanungoAbstract:Modern web Search engines are federated --- a user query is sent to the numerous specialized Search engines called verticals like web (text documents), News, Image, Video, etc. and the Results returned by these engines are then aggregated and composed into a Search Result Page (SERP) and presented to the user. For a specific query, multiple verticals could be relevant, which makes the placement of these vertical Results within blocks of textual web Results challenging: how do we represent, assess, and compare the relevance of these heterogeneous entities? In this paper we present a machine-learning framework for SERP composition in the presence of multiple relevant verticals. First, instead of using the traditional label generation method of human judgment guidelines and trained judges, we use a randomized online auditioning system that allows us to evaluate triples of the form query, web block, vertical>. We use a pairwise click preference to evaluate whether the web block or the vertical block had a better users' engagement. Next, we use a hinged feature vector that contains features from the web block to create a common reference frame and augment it with features representing the specific vertical judged by the user. A gradient boosted decision tree is then learned from the training data. For the final composition of the SERP, we place a vertical Result at a slot if the score is higher than a computed threshold. The thresholds are algorithmically determined to guarantee specific coverage for verticals at each slot. We use correlation of clicks as our offline metric and show that click-preference target has a better correlation than human judgments based models. Furthermore, on online tests for News and Image verticals we show higher user engagement for both head and tail queries.
