    Abstract:

    Russia had few Temporary Workers in the 1990s, but after the fall of the Soviet Union and the entrance of foreign MNCs, the percent of Workers on Temporary contracts grew in 2014. In 2016, a new law was implemented that bans hiring Temporary Workers except through government-accredited agencies, but only for the purpose of substituting for employees who are temporarily absent from the workplace; to assist in the Temporary expansion of production or services (for up to a maximum of nine months); and to provide Temporary employment to certain approved categories of Workers (i.e., full-time students, single parents, parents of multiple children, and former convicts). This paper will compare and contrast the current labor protections of Temporary dispatch Workers in the U.S. and Russia, with consideration also of the recent legislative labor protections provided in the East Asian countries of China, South Korea, and Japan. Following the Introduction, the paper, in Part I discusses the phenomena of “fissurization,” in employment relations and its resulting legal implications for the regulation of “dispatch (agency)” Workers in the above countries. Part II compares and contrasts the regulatory approaches of the U.S. with Russia and the East Asian countries of China, Japan, and South Korea; and the Conclusion follows. Perhaps the menu of regulatory legislation provided in this paper will be useful for those looking for the tools to construct dispatch regulation in the U.S.

    Abstract:

    A industria sucroalcooleira, nos moldes que se apresenta na atualidade brasileira, implica na geracao de impactos economicos, ambientais e sociais. Nesse ultimo ressalta-se a geracao de empregos e a constituicao do profissional temporario, o cortador de cana. A pesquisa teve como objetivo caracterizar algumas variaveis socio-economicas relativas ao trabalhador temporario da agroindustria canavieira de Lagoa da Prata, Minas Gerais. O trabalho buscou, mediante uma pesquisa documental exploratoria de natureza quantitativa e descritiva, caracterizar o perfil socio-economico dos trabalhadores temporarios da agroindustria canavieira de Lagoa da Prata - MG. Os resultados indicam que a maioria dos trabalhadores temporarios do setor sucroalcooleiro sao migrantes, homens e jovens, com ensino fundamental incompleto, sendo a maioria nao sindicalizado. A presenca majoritaria de jovens evidencia a correlacao entre a disposicao fisica e a forca muscular exigida pelo trabalho proposto. A maioria sendo migrantes sazonais pode ser explicada pela inibicao dos trabalhadores locais diante do baixo salario oferecido, associados ao trabalho pesado e desgastante do corte da cana. A priorizacao do trabalhador do sexo masculino em detrimento do sexo feminino se justificou pela superioridade biologica natural para o desempenho do trabalho e pela maior oferta de mao-de-obra.

    Abstract:

    Some of the most vexing and persistent questions in U.S. immigration policy involve whether and how to design programs to admit Temporary Workers. These questions often prompt disagreement, even among those who otherwise agree on many aspects of immigration law and policy. To address these questions, this Article starts with a brief overview of Temporary Worker admissions in U.S. immigration law today, and then summarizes the main points typically made by supporters and skeptics. It next identifies key questions for those who would design Temporary Worker programs. The main part of the Article then explains how analysis of Temporary Worker programs generally reflects some combination of four broad perspectives. One perspective evaluates Temporary Worker programs as a force in the U.S. economy that benefits many citizens and permanent residents but disadvantages others. A second perspective views admission of Temporary Workers not only in comparison to its traditional foil — admission of permanent residents — but also to immigration outside the law. A third perspective analyzes Temporary Worker admissions not only as a vital facet of immigration law, but also as essential to international economic development. A fourth perspective assesses Temporary admissions in the context not just of immigration law, but also of citizenship, especially by looking at the integration of future generations. Comparing and evaluating these four perspectives can shed light on current debates by broadening and deepening analysis of Temporary Worker programs. Overall, the broad assessment provided by a balanced combination of these perspectives generally suggests cautious support for Temporary Worker programs, but only if they are carefully designed and coordinated with initiatives outside of immigration law.
