    Ever since the “Solid Waste Disposal Act” was established in 1974, Taiwan has been developing Waste management for nearly four decades. Over the years, the substantial increase in the amount of solid Waste and the indiscriminate Disposal of Waste had caused serious environmental pollution problems. In 1984, the “Municipal Solid Waste (MSW) Disposal Plan” set landfill as the initial goal and incineration as the long-term policy. The “MSW Disposal Plan” was promulgated in 1991, empowering the Government to construct 21 incineration plants to relieve from the burdens of MSW pollution.

    Abstract:

    오늘날 폐기물문제는 국내외적으로 중요한 국가과제로 자리매김하고 있다. 이와 같은 폐기물문제의 근원은 대량생산ㆍ대량소비ㆍ대량폐기형의 경제활동에 의해 질ㆍ양 양면에 걸쳐서 환경부하가 증대하고 있는 것에 있다고 할 수 있을 것이다. 따라서 「대량생산ㆍ대량소비ㆍ대량폐기형의 사회에서 순환형사회로의 전환」은 이제 피할 수 없는 시대적 요청이 되고 있다. 한편, 일본에서는 2000년 6월에 「순환형사회형성추진기본법」이 제정되어 순환형사회의 형성에 향한 움직임이 구체화하게 되었다. 특히 폐기물처리법과 관련하여서는 그동안의 문제점을 근거로 하여 2010년 5월 19일 개정된 법률이 2011년 4월 1일부터 시행되고 있다. 개정폐기물처리법에서는 폐기물처리에 대한 국민의 신뢰를 회복하면서 장기적인 폐기물의 적정처리체제를 구축하고 순환형사회만들기를 진행하기 위해 배출사업자에 의한 적정한 처리를 확보하기 위한 대책의 강화, 폐기물처리시설의 유지관리대책의 강화, 산업폐기물처리업의 우량화의 추진, 배출억제의 철저, 적정한 순환적 이용의 확보, 소각 시의 열이용의 촉진 등을 지주로 하는 종합적인 대책을 강구하는 것으로 하고 있다. 우리나라에서는 폐기물관리법이 폐기물에 관한 기본법 내지 일반법의 지위를 가지고 있는 바, 그동안의 시행과정에 있어서의 문제점을 근거로 하여 2010년 7월 23일 비교적 큰 폭으로 개정되어 2011년 7월 24일부터 시행될 예정이다. 개정폐기물관리법은 폐기물관리의 기본원칙의 명시, 중간가공 폐기물에 대한 처리 기준과 방법 완화, 재활용 용도 또는 방법에 관한 기준 및 재활용제품에 관한 유해성기준 도입, 음식물류 폐기물 감량의무 배출자 범위 확대, 수입폐기물에 대한 반출명령 도입, 폐기물 재활용업의 체계화ㆍ세분화 등, 폐기물처리업 휴ㆍ폐업 시 폐기물 처리의무 도입, 사업장폐기물배출자 및 폐기물처리업자 등에 대한 보관 폐기물의 처리명령제도 도입, 폐지ㆍ고철 등의 폐기물을 수집ㆍ운반ㆍ재활용하는 대규모 사업자에 대한 신고제의 도입 등을 주된 내용으로 하고 있다. 또한 정부에서는 2010년 12월 30일 음식물류 폐기물과 가축분뇨를 함께 처리하는 폐기물처리시설 설치 시 행정절차의 간소화 및 폐기물매립시설에 대한 검사제도의 도입 등을 내용으로 하는 폐기물관리법개정안을 국회에 제출해 두고 있다. 요컨대, 이와 같은 폐기물법제의 개혁으로 인하여 폐기물의 적정처리의 확보 및 순환형사회의 형성은 한층 더 진척될 것으로 사료된다. 다만, 이른바 순환형사회를 형성하기 위해서는 폐기물의 개념을 재정립함과 아울러 가칭 「자원순환기본법」을 조속히 제정하여야 할 것으로 본다.

    AbstrAct In order to conservatively utilize natural resources, Taiwan’s Environmental Protection Administration (EPA), in cooperation with the Ministry of Economic Affairs (MOEA), has mandated the regulatory system and promotion programs for industrial Waste reuse and pollution prevention. The newly-designated 43 items for reuse were promulgated by the MOEA under the authorization of the Waste Disposal Act (WDA) in January 2002. Also, joint efforts at industrial Waste minimization (IWM) have made noteworthy progress towards the promotion of reusing/reducing industrial Waste since 1990. The IWM program not only provides technical assistance and financial incentives, but also enhances resource reuse and conservation through Industrial Waste Exchange Information Service Center. These measures have brought significant benefits by saving treatment/Disposal costs and improving productivity. This paper presents the regulatory system and implementation promotion on industrial Waste reuse and pollution prevention in Taiwan.
