    Abstract:

    This study presents an analytical framework of the product take back Legislation in the context of product reuse. We characterize existing and proposed forms of E‐Waste Legislation and compare their environmental and economic performance. Using stylized models, we analyze an OEM's decision about new and remanufactured product quantity in response to the legislative mechanism. We focus on the 2012 Waste electrical and electronic equipment directive in Europe, where the policy makers intended to create additional incentives for the product reuse. Through a comparison to the Original 2002 version of the directive, we find that these incentives translate into improved environmental outcomes only for a limited set of products. We also study a proposed policy that advocates a separate target for the product reuse. Our analysis reveals that from an environmental standpoint, the Recast version is always dominated either by the Original policy or by the one that advocates a separate target for product reuse. We show that the benefits of a separate reuse target scheme can be fully replicated with the aid of fiscal levers. Our main message is that there cannot be a single best environmental policy that is suitable for all products. Therefore, the consideration of product attributes is essential in identification of the most appropriate policy tool. This can be done either by the implementation of different policies on each product category or by implementation of product‐based target levels.

    Abstract While the Waste hierarchy promotes the reuse of Waste there currently remains limited reuse of mine Waste in South Africa. Overburden, Waste rock, tailings and slag are stockpiled or disposed leading to environmental liabilities including acid mine drainage and leaching. Globally there are numerous documented uses of mine Waste. However, South African Waste Legislation currently fails to create an enabling environment for mine Waste reuse, and consequently hinder the generation of economic value from this Waste stream. Mine Waste in South Africa is defined as a residue, which is considered a resource of minerals for future re-mining. Being classified as hazardous, the reuse of mining residue is legally challenging in South Africa. Furthermore legislated environmental management process promotes cradle-to-grave approaches, which is not supportive of any Waste reuse initiative. Legislative authorisation falls between two government departments’ often with conflicting mandates leaving mine residue becoming trapped between being a Waste and being a by-product with economic value.

    ‡HE LEGAL DEFINITION OF Waste CAN often be vague and dependent on factors other than the composition or possible after-use of the material. The European Court of Justice has stated that the term ‘Waste’, in European Union Legislation, implies ‘discard’. In South Africa, there is currently more than one legal definition of Waste. This not only complicates the classification of material as Waste, but also creates confusion amongst industry and government dealing with Waste management issues. This hinders the successful implementation of the Waste hierarchy that aims at diverting Waste away from landfill by promoting sustainable Waste recycling and re-use. The aim of this paper is to provide a critical analysis of the definition of Waste and the shift to Waste as resource, and the implications thereof for the implementation of government policies, strategies and Legislation on Waste re-use and recycling. Special emphasis is placed on the South African situation where new Waste Legislation is currently under development.

    Like many areas of its constitution, South Africa has progressive Legislation to both prevent and clean up environmental contamination. However, recent research has highlighted a large gap between Legislation and practice. This paper presents the context of the intent of environmental Waste Legislation in South Africa and highlights a case of mercury contamination in a rural area which illustrates the gap between the theory of Legislation and the reality on the ground. Mercury contamination in humans poses well known health threats, yet despite attention from the media, non-governmental organisations and academic researchers, a major pollutant remains and contamination levels remain high, two decades after the original polluting incident took place.

    The substitution potential of sewage sludge for German primary phosphate imports has been estimated as 40%. Yet, a marketable option for the full scale recovery has been lacking. This study focuses on a full-scale process for the manufacture of a P-fertilizer from sewage sludge ash (SSA) adapted from the production of Triple Superphosphate. Given (i) conformity of the input with phosphate ores mined from sedimentary deposits, (ii) comparability of the product with a commercially available P-fertilizer regarding contaminant levels, P-fractionation and yield effects, and (iii) compliance of the output with the German Fertilizer Ordinance the RecoPhos P 38 fertilizer was discharged from the Waste Legislation regime. The fertilizer is currently being produced at a rate of 1000 tonnes per month and sold at a competitive price.

    The Waste Framework Directive 2000 /98 (WFD) contains specific requirements to define end-of-Waste criteria (EWC). The main goal of EWC is to remove and eliminate the administrative loads of Waste Legislation for safe and high-quality Waste materials, thereby facilitating and assisting recycling. The target is to produce effective with high quality of recyclables materials, promoting product standardization and quality and safety assurance, and improving harmonization and legal certainty in the recyclable material markets. At the same time, those objectives aim to develop a plan in order to improve the development and wider use of environmental technologies, which reduce pressure on environment and at the same time address the three dimensions of the Lisbon strategy: growth, jobs and environment. This paper presents the importance of EWC, and the approach of setting EWC as EWC affect several management systems as well as sustainable and clean technologies.
