    Abstract:

    Title III of the Omnibus Crime Control and Safe Streets Act of 1968 prohibits the intentional interception of any telephone conversation without the consent of one of the parties to the conversation. Although wiretapping evokes images of the Watergate scandal or commercial espionage, Approximately 68 Percent of all reported wiretapping matters involve one spouse's attempt to obtain evidence for use against the other spouse. Despite the prevalence of interspousal electronic surveillance, Title III fails to directly address the issue of whether such wiretapping activities are legal. This Article examines the issue of whether an implied interspousal immunity exception exists in Title III. Part I provides a context for the analysis by discussing the traditional approach taken by courts in interpreting statutes: that is, where courts consider the plain meaning of the text of the statute and then consider its legislative history to determine whether the plain meaning should be superseded by contradictory legislative history. Part II applies the traditional approach of statutory construction to Title III and concludes that neither the plain meaning of the text of Title III nor its legislative history support the existence of an implied interspousal immunity exception. Indeed, an examination of the entire legislative history of Title III, some of which has been ignored by those courts which have carved out an implied interspousal immunity exception, clearly demonstrates that Congress specifically intended to prohibit all electronic surveillance, including interspousal electronic surveillance, and specifically rejected a predecessor bill because it failed to prohibit such conduct. Part III then examines several policy considerations which undermine application of the interspousal immunity exception to Title III, including personal privacy concerns. The Article concludes by stating that an implied interspousal immunity exception in Title III does not and should not exist, and that the creation of such an exception by the courts represents misapplied, extralegal policy making.

  • Synthesis, ^99mTc-radiolabeling and in vivo evaluation of a new sulphonamide derivative for solid tumor imaging

    A novel sulphonamide derivative (EPBS) was prepared at high yield and characterized by ^1H NMR and infrared radiation spectroscopy. Its cytotoxic activity was examined in breast carcinoma (MCF-7) cells at a dose of 25 μg/mL. Approximately 68 Percent effective inhibition has been achieved. Furthermore, the synthesized ligand was directly radiolabeled with technetium-99m using sodium borohydride. High radiochemical purities (95.5%) were determined using radio-paper chromatography and electrophoresis. Its in vivo evaluation in tumor bearing mice demonstrated a high tumor uptake of the ^99mTc-EPBS complex at 30 min post injection (6.74%) and tumor/muscle (T/NT) ratio equal to 5.04 ± 0.05. In conclusion, ^99mTc-EPBS agent showed favorable characteristics for the radio-diagnosis of solid tumors.

    Purpose: The purpose of this study was to evaluate dental care access and sealants prevalence among children with special health care needs. Methods: The authors utilized the publicly available National Health and Nutrition Examination Survey (NHANES) 2013 to 2014 datasets collected by trained dental examiners for the Centers for Disease Control and Prevention. This study included 2,651 six- to 19-year-olds who provided demographic, dental visit, disability, and sealants information. Weighted prevalence estimates and odds ratios (OR) were calculated for sealant use by disability, gender, age, race, and economic status. Results: Approximately 68 Percent of participants had a dental visit in the past six months, with 84 Percent of them being routine dental visits; each had Approximately two sealed teeth (mean equals 2.37). Children with a physical disability have lower odds of having a sealant (OR equals 0.5; P=0.04) compared to nondisabled children. Six- to 11-year-olds have lower odds of having a sealant versus older age groups. Sealant use prevalence was lowest among African American children (39 Percent) versus Hispanic (47 Percent) and Caucasian (54 Percent; P=0.01) children. Conclusions: The findings indicate disparities in dental sealants use among those with physical disabilities and younger age groups. Further studies and strategies are needed to intervene at an early age and increase utilization of sealants among children with special health care needs.   • Policy implications of rationalization of statin use in Lithuania

    Abstract:

    OBJECTIVES The aim of this study was to assess the trends and costs of statin use in Lithuania over a 3-year period and perform a cost-minimization and reference price analysis to rationalize the use of financial resources of the National Health Care System. METHODS The defined daily dose (DDD) methodology was applied for assessment of statin use, which was expressed in DDD/1,000 inhabitants/day. Cost minimization and reference price calculations were used in the economic analysis. RESULTS Over the 3-year period (2005-2007), the consumption and expenditures of statins in Lithuania doubled. The consumption went up from 3.87 DDD/1,000 inhabitants/day (in 2005) to 8.35 DDD/1,000 inhabitants/day (in 2007). Total expenses of statins increased during the same period from LTL6.186 million in 2005 to LTL12.418 million in 2007. Approximately 68 Percent of the estimated costs for statins in 2007 were for atorvastatin. Provided that the calculated reference prices were fixed, the estimated savings would amount to a minimum of LTL1.371 million per year and could reach yearly savings in the order of LTL3.163 million. The total expenses would drop by at least 11 Percent, and the decrease in costs could be as high as 25 Percent (1 euro = LTL3.4528). CONCLUSIONS Statins consumption is still very low in Lithuania in comparison with other European Union countries. Implementation of cholesterol education programs and changing reimbursement profile for statins therapy will increase consumption and expenditures. The introduction of reference-based pricing as an indirect cost control policy would help rationalizing the use of statins and their expenditures.
