    Abstract:

    En este artículo exponemos los resultados de la autopsia de un varón joven que falleció en el hospital por un cuadro de delirium agitado. Es un síndrome caracterizado generalmente por agitación psicomotriz, agresividad y puede producir muerte súbita, en ocasiones durante la aplicación de métodos de contención mecánica por los Cuerpos de Seguridad del Estado o personal sanitario. Está típicamente asociado al consumo de drogas de abuso, como la cocaína. En estos casos, estará incluida en el grupo de muertes en custodia, que es aquella que se produce cuando la víctima se encuentra privada de libertad. Tiene una indudable repercusión médico legal, puesto que se considera prototipo de muerte sospechosa de criminalidad.in this article we present the autopsy of a young man who died in hospital by excited delirium.     Abstract:

    Deaths in Custody warrant scrutiny, not only because they might be due to torture, abuse and inadequate medical care, but also because they pose challenges for detaining authorities. It is a widely overlooked problem that in many prisons Deaths are frequent and most of them are considered ‘normal’ or ‘natural’ and not necessarily investigated while some of them were preventable. The lack of guidance to health care workers or international personnel in the field as to how to proceed in cases of Deaths in Custody is one of the reasons why investigations into Deaths in Custody are not conducted or are ineffective. in light of this real and persistent problem, a multidisciplinary research project on the legal, medical and forensic aspects of investigating Deaths in Custody has been carried out between 2008 and 2013 by the University Centre for Legal Medicine of Geneva and Lausanne, the Geneva Academy of international Humanitarian Law and Human Rights, the University of Bern, the international Centre for Prison Studies (King’s College London) and the ICRC. As a result of this collaborative effort, the Guidelines for investigating Deaths in Custody have been published by the ICRC in 2013. The latter Guidelines fill an important gap by offering practical guidance to detaining authorities, investigating authorities, humanitarian agencies and others on the standards and procedures to be followed when a Death occurs in Custody. This chapter presents the background, content and usefulness of the Guidelines after having discussed some of the key medical and legal issues related to Death in Custody such as: how to define Deaths in Custody? What are the most prevalent causes of Deaths in Custody? What is the legal framework pertaining to the prevention and investigation of Deaths in Custody? How to investigate and prevent Deaths in Custody?

    Abstract:

    Prisoners sometimes die in prison, either due to natural illness, violence, suicide, or a result of imprisonment. The purpose of this study is to understand Deaths in Custody using qualitative methodology and to argue for a comprehensive definition of Death in Custody that acknowledges Deaths related to the prison environment. interviews were conducted with 33 experts, who primarily work as lawyers or forensic doctors with national and/or international organisations. Responses were coded and analysed qualitatively. Defining Deaths in Custody according to the place of Death was deemed problematic. Experts favoured a dynamic approach emphasising the link between the detention environment and occurrence of Death rather than the actual place of Death. Causes of Deaths and different patterns of Deaths were discussed, indicating that many of these Deaths are preventable. Lack of an internationally recognised standard definition of Death in Custody is a major concern. Key aspects such as place, time, and causes of Death as well as relation to the prison environment should be debated and incorporated into the definition. Systematic identification of violence within prison institutions is critical and efforts are needed to prevent unnecessary Deaths in prison and to protect vulnerable prisoners.

    Abstract:

    The Death of an Aboriginal man, Mulrunji, in an Australian police cell in 2004 precipitated an extraordinary response from the community. The usual distinctions between the roles of police, coroner, prosecutors and politicians became confused and merged in the media maelstrom that followed the Death. Uneasy alliances developed which qualified the binary response of right versus wrong. Could the coroner's findings be reconciled with the decision of the prosecutor not to try the police officer involved? Was the government's response of overriding the decision of the independent prosecutor justified? What does this case tell us about the adversarial and inquisitorial approaches to evidence? This paper examines the tensions at play in the response to the Death of Mulrunji and explores the wide reaching implications for law and justice in Death in Custody cases.
