    Abstract:

    En el año 2011 se creó la Confederación de Trabajadores de la Economía Popular (CTEP). En el año 2015, a los albores del cambio de gobierno, se le concedió la personería social, a pesar de que su demanda era la “gremial”. En el año 2016, en conjunto con una amplia gama de organizaciones, sumadas la CGT y las CTAs lograron proponer con éxito la Ley de Emergencia Social que los reconoce como trabajadores de la economía popular, con derecho al salario social complementario (MALDOVAN, et. Al, 2017). En el presente artículo se analizan las acciones y estructura organizativa de la CTEP, sus principales demandas y participación en el espacio público así como ciertos aspectos de las relaciones que establece con el sistema político institucional. El análisis que presentamos recoge resultados de entrevistas en profundidad y datos de carácter estadísticos, en particular, de la construcción de una base de datos realizada sobre la página oficial de la CTEP. Concluimos que como organización se encuentra tensionada entre lo corporativo y lo político, entre lo sindical y lo movimental. Pero esto no es el resultado de una falta de definición. Así como existe en el mundo una tendencia hacia el “sindicalismo de movimiento social”, en Argentina se puede observar un proceso de “movimiento social hacia el sindicalismo”.In 2011 was born the Popular Economy Worker’s Confederation CTEP. In 2015, the changing government gives to CTEP the social legal status, despite it asks for the trade union status. In 2016, with a several social organizations, unions and the two main confederations of trade unions (CTA), the CTEP, they prompted the Social Emergency Law, which recognizes them as workers of the popular economy and the right to the “social complementary salary”. This paper analyses the actions, organization and demands as well as certain aspects of its relations with the political system. In order with that, we used deep interviews, statistical data, in particular, one data base that we construct from the official webpage of CTEP. We concluded that this is tensioned between political and corporative goals, between the unionism and the movement aspects. But this is not a problem of definitions.   • A Theory of Human Rights Accountability and Emergency Law: Bringing in Historical Institutionalism

    Abstract:

    The relationship between Emergency legislation and government accountability for human rights violations has captured the interest of scholars and political officials since the War on Terror commenced. However, the use of Emergency Laws by democracies during a crisis is not novel. Through comparative analysis of the conflicts in Sri Lanka and Northern Ireland, this article illustrates that governments have used these Laws as a means to avoid judicial accountability for decades. Moving beyond existing research that tends to offer normative models for achieving government accountability in the midst of crisis, this article provides findings on the precise conditions that constrain or enable accountability in the presence of restrictive Laws. Drawing on historical institutionalism, the article argues that key features of the political context, including veto power, the degree of legal regulation, and opportunities for judicial challenges, shape the extent to which Emergency legislation acts as a constraint o...

    This paper and an attached compendium attempt, for the first time since the 1970s, to reach a reasonably complete assessment of the number of national emergencies now in effect in the United States and the powers these emergencies confer on the Executive Branch. The paper also proposes specific statutory reforms to rein in the unchecked growth of these emergencies, and political reforms to subject the vast executive powers granted by the U.S. Emergency Law regime to the democratic process.

    Abstract:

    Unbenownst to most Americans, the United States is presently under thirty presidentially declared states of Emergency. They confer vast powers on the Executive Branch, including the ability to financially incapacitate any person or organization in the United States, seize control of the nation’s communications infrastructure, mobilize military forces, expand the permissible size of the military without congressional authorization, and extend tours of duty without consent from service personnel. Declared states of Emergency may also activate Presidential Emergency Action Documents and other continuity-of-government procedures, which confer powers on the President—such as the unilateral suspension of habeas corpus—that appear fundamentally opposed to the American constitutional order. Although the National Emergencies Act, by its plain language, requires Congress to vote every six months on whether a declared national Emergency should continue, Congress has done so only once in the nearly forty-year history of the Act.
