When talking about DSA, the most discussed topics revolve around particular technologies such as cognitive radios or particular solutions such as the advanced wireless services-3 initiative. However, in this work, we explore a less discussed approach for spectrum sharing: the Federal Communications Commission (FCC)’s experimental radio service (ERS). The ERS grants licenses for experimentation, market trials, and product development in Federal and/or non-Federal bands. Frequencies in these licenses are assigned on a shared basis and not for the exclusive use of any one licensee. Using FCC’s scraped information in the period between 2007 and 2016, we were able to gain a deeper understanding of the ERS. We find that the processing time (i.e., time to get a license) has been reduced from 100 days to an average of 23 days in 2016. Moreover, the assignation process of experimental licenses is characterized great flexibility in terms of the authorized technical and nontechnical characteristics. We also explored what is behind these 10 years of information.

In this work, we present an exploratory analysis of the details pertaining to the assignment of these licenses during the past ten years (2007-2016). For this purpose, we have built a single repository of technical and non-technical details about license applications by scraping publicly available information in the FCC’s website. This has permitted us systematically categorize among the existing types of experimental licenses and, subsequently, analyze their characteristics. We pay particular attention to the evolution of various parameters such as duration of license, frequency of assignment, processing times, operational parameters, among others. In addition, we explore potential trends hidden in ten years of experimental licenses. This allow us to better understand the time burden of obtaining an authorization or the factors that may influence the license granting process.We conclude this work by delving into the details behind the relationship between ERS authorizations and well known wireless technologies, in particular TV White Spaces and 5G.

Communication technology at the Federal Communications Commission: E-government in the public interest?

Mcgregor, Joanne HolmanAbstract:Abstract Just as the private sector has discovered the potential of e-commerce as a cost-effective means to market goods and services to consumers, the public sector has begun to examine the potential of on-line government (e-government) as an efficient way to interact with citizens and businesses. In recent years in the United States, Federal “e-government” initiatives have prompted administrative agencies to use new communication and information technologies like the Internet and World Wide Web (Web) to provide information, deliver services, and channel feedback from citizens, regulated industries, and other government entities. But the question remains: How well will these e-government initiatives, particularly the use of communication and information technologies, serve the public at whom they are directed? This article offers a limited study of the use of a specific communication technology—the Web—by the Federal Communications Commission (FCC). This article considers the usefulness of FCC's Web site for both regulated industries and the public. The article provides a careful comparison of the ways the site allows regulated industries to conduct their official business with the ways the site permits the public to participate in FCC processes.

Whispering Into Princes’ Ears: A Empirical Descriptive Analysis of Comments and Ex Parte Meetings at the Federal Communications Commission
Social Science Research Network, 2018Co-Authors: Adam Candeub, Sherrod BlanknerAbstract:Abstract: The Federal Communications Commission (FCC) produces most of its regulations through informal notice-and-comment rulemaking. Under this process, the FCC promulgates a proposed rule and then solicits public comments before issuing a binding regulation. Its procedures also allow Commissioners and staff to meet with regulated entities and their attorneys in on-going matters, but after these private, in-person meetings, parties must submit an “ex parte letter” listing the meeting’s attendees and the matters discussed. These letters describing face-to-face meetings are filed alongside public comments in the FCC’s electronic comment filing system (ECFS). In addition, the FCC relies upon ECFS database for types of activities other than rulemaking, namely adjudications, a category that includes spectrum assignment, merger approval, and enforcement. This paper provides an empirical analysis of the approximately 4.4 million separate submissions and filings on ECFS during the period of 2006-2016 with special attention to comments and ex parte meetings. In this largely descriptive paper, we analyze this data to answer several questions: what areas appear to dominate the FCC’s attention, as measured by number of meetings and paper submissions; what does a “typical” FCC proceeding look like; which parties, law firms, and lobbyists dominate the FCC’s attention, as measured by number of meetings and paper submissions; and, finally, what types of activity seem most correlated the FCC action.

Political Drivers and Signaling in Independent Agency Voting: Evidence from the Federal Communications Commission

Our model relates the costs faced by the FCC Chairs -- and, by extension, presidents -- of advancing their agenda to Commissioner voting. The model shows that divided government, with its increased cost of legislative achievement, increases partisan Commissioner voting. To test the model, we use a unique and comprehensive data set, spanning 9,151 orders and 35,194 individual Commissionervotes over 35 years to examine the factors driving Commissioner voting. Employing logit choice models, we find significant evidence that periods of split government are correlated with more partisan voting. We also find significant evidence of signaling by Commissioner voting. Specifically, the partisan composition of the D.C. Circuit drives dissenting, suggesting that Commissioners use dissenting to signal sympathetic judges reviewing those orders.

Political and Institutional Determinants of Independent Agency Voting: Evidence from the Federal Communications Commission (FCC)
SSRN Electronic Journal, 2011Co-Authors: Adam Candeub, Eric HunnicuttAbstract:We use a unique and comprehensive data set, spanning 9,151 orders and 35,194 individual Federal Communications Commission (FCC) Commissioners’ votes over 35 years to examine the factors driving Commissioner voting. Employing logit and probit choice models, we find significant evidence of political control. Specifically, Congress appears to gain greater control from the President over Commissioner voting during periods of split government. Such periods produce greater dissenting by Commissioners belonging to the party opposite the Chair’s. In addition, Commissioners use voting to influence or signal judges reviewing FCC orders. Dissenting increases with the percentage of judges on the U.S. Court of Appeals for the D.C. Circuit appointed by a president of opposite party as the FCC Chair. Finally, we find institutional determinants of Commissioner voting, specifically Commissioner dissenting increases in the later years of their terms.

Duke Law Journal, 2006Co-Authors: De Figueiredo, M JohnAbstract:This paper examines the theoretical promise of e-rulemaking with an examination of data about all filings at the Federal Communications Commission (FCC) from 1999 to 2004. The paper first reviews the theoretical and empirical literature on e-rulemaking. It then analyzes a dataset of all filings at the FCC using descriptive statistics and regression analysis to determine what drives e-filings and whether the theoretical promise of e-rulemaking is being realized six years into the experiment. The paper finds that though there has indeed been a long-term trend away from paper filings and toward electronic filings, citizen participation seems not to have increased from earlier time periods. Rather, e-filing has become a marginal change to the rulemaking process and merely another avenue by which interested parties file comments.
