Governing International Criminal Justice: Managerial Practices and the International Criminal Court
'Organisation for Economic Co-Operation and Development (OECD)', 2020Co-Authors: Clements, Richard AndrewAbstract:Managerial practices such as strategic planning, audit, and performance appraisal pervade global governance regimes, including the regime of international criminal justice (ICJ). The mainstream view is that such practices are objective tools which optimise institutional performance and thereby assist them in attaining their goals. Against this view, I offer an alternative understanding of managerial practices. Viewing international criminal justice as a technocratic imaginary, and defining managerial practices as tools of power/knowledge, I explore the discursive effects of management upon the contemporary project of ICJ. I problematize the assumptions inherent in the mainstream approach to managerial practices, relying on critical international law and critical management scholarship to provide a comprehensive sociology and history of management. Employing a Genealogical Method, I trace the historical journey of managerial practices from the steel factories of the American Midwest to the structures of the United Nations after decolonization. This genealogy reveals the political significance of management as a set of tools deployed to reinforce extant distributions of institutional power. At the International Criminal Court (ICC), I trace the expansion of managerial practices and find them to have certain reality- and identity-making effects on the organisation and its professional staff. Managerial practices produce the court as an efficient, modern institution, reinforcing the image of ICJ as the optimal allocation of institutional resources by experts. Such practices also produce the identity of the ICC lawyer as an efficient cog in the ICJ machine. Collectively, managerial practices enact a discursive closure around an institutional and expert-driven ICJ project. That discursive closure is illustrated further in two detailed studies: the ICC Presidency and the reorganisation of the Registry. The overall research aim of Genealogical analysis is to produce “a history of the present”, a history which is essentially critical with its focus on locating forms of power, the channels it takes and the discourses it permeates. Research combining Foucauldian theorisation and Method necessarily involves a selective search for injustice and subjection to reveal plausible alternatives to more pervasively modernist histories, which tend to revere progress. Salient features of a Genealogical research Method are detailed in the context of an actual research project previously conducted by the authors and reproduced here for the purposes of exemplification explicitly as a genealogy.

Nietzsche: de la decadencia en el trabajo a la ascendencia en el capitalismo

However, despite being decadent, ascending life is possible within it. To this effect, this article explains what Nietzsche understood by decadence, its causes, some of its consequences and, in particular, the reason why work in the capitalist context is a further result of the decadence of culture. It also explains how ascending life is possible, despite being immersed in a decadent context. For this purpose, the roles of the business owner and his/her employees are analyzed. Methodology: this study proceeds Methodologically through the philosophical analysis of concepts. Thus, the Genealogical Method of Nietzsche is applied, with which the restrictive vision of ethics is confronted, according to which it seems as if it were based on previous, absolute, not demonstrable and dogmatic assumptions. Nietzsche's thought, then, constitutes not only a theoretical reference, but also a Methodological model to address this issue. Results: Nietzsche's philosophy has implications on capitalism and contemporary business life. Conclusions: ascending life within the capitalist context is very difficult to reach and only a few exceptional beings, who tend to the Übermensch, achieve it.Objetivo: evidenciar elementos para defender la idea de que el trabajo en el contexto capitalista es, desde Nietzsche, decadente, pero que, a pesar de ser decadente, es posible la vida ascendente en él. Para ello, este artículo explica qué entendía Nietzsche por decadencia, cuál fue la causa de esta decadencia, algunas de sus consecuencias y, en especial, por qué el trabajo en el contexto capitalista es una consecuencia más de la decadencia de la cultura. También explica cómo, a pesar de estar inmersos en un contexto decadente, es posible la vida ascendente. Para esto, se analiza el papel del dueño de empresa y de los empleados de ella. Metodología: este estudio procede metodológicamente mediante el análisis filosófico de conceptos. Así, se aplica el método genealógico de Nietzsche, con el que se enfrenta la visión restrictiva de la ética, según la cual pareciera como si ésta partiese de supuestos previos, absolutos, no demostrables y dogmáticos. El pensamiento de Nietzsche, entonces, constituye no sólo un referente teórico, sino también metodológico para abordar este tema. Resultados: la filosofía de Nietzsche tiene implicaciones sobre el capitalismo y la vida empresarial contemporánea. 2010Co-Authors: Brian LightbodyAbstract:Philosophical genealogy is a distinct Method of historical and philosophical inquiry that was developed by the nineteenth-century philosopher, Friedrich Nietzsche, and subsequently adopted and extended by the twentieth-century philosopher, Michel Foucault. In brief, genealogies critically examine the historical origin of philosophical concepts, ideas and practices. They challenge the value of traditional Methods of philosophical inquiry along with the results that these inquiries produce. "Philosophical Genealogy Volume I: An Epistemological Reconstruction of the Genealogical Method" explored the three axes of the Genealogical Method: power, truth and the ethical. In addition, various ontological and epistemic problems pertaining to each of these axes were examined. In "Philosophical Genealogy Volume II: An Epistemological Reconstruction of the Genealogical Method", these problems are now resolved. Volume II establishes what requisite ontological underpinnings are required in order to provide a successful, epistemic reconstruction of the Genealogical Method. Problems regarding the nature of the body, the relation between power and resistance as well as the justification of Nietzschean perspectivism, are now all clearly answered. It is shown that genealogy is a profound, fecund and, most importantly, coherent Method of philosophical and historical investigation which may produce many new discoveries in the fields of ethics and moral inquiry provided it is correctly employed.
