    Abstract:

    Taking the run-up to the 2012–2016 Management Contract between Flemish public service broadcaster VRT and the Flemish government as a case study, this article analyses the role of the digital technology argument in debates and negotiations regarding the position of public service broadcasting (PSB) in the era of media convergence. It discusses the outcome of the 2011 Contract negotiations as the result of the relative position and impact of different actors by means of a stakeholder analysis and advocacy coalition framework. Results suggest, first, that beneath surface discussions about PSB and new media are economic arguments and logics. They show, second, that two advocacy coalitions can be identified and that the negotiations’ outcome reflects a rupture of ties in the advocacy coalition between right-wing political parties and private media companies, favouring a market failure perspective, to the benefit of the advocacy coalition promoting the social responsibility perspective, reflected in the eventu...

    Abstract:

    This article analyses the increasing emphasis on multi-stakeholder approaches in the development of public broadcasting policies. The European Commission, in particular, reinforces this trend, having pointed to the necessity of ‘third parties’ being involved in procedures that allow public broadcasters to expand activities to new media markets. The article’s research question is twofold. First, what type of multi-stakeholder approach has been advocated for by the Commission? Second, are multi-stakeholder approaches, implemented by Member States after an encounter with the Commission, adding to more democratic (understood as more inclusive) decision-making on public service broadcasting or, rather, simply providing an additional forum for private sector interests?     Abstract:

    Energy conservation is a challenging and difficult task because disincentives in the building sector inhibit innovation. The municipality of Rotterdam experimented with an energy performance Contract that aimed to avoid disincentives and replace them with a stimulus for innovation. This article investigates whether the design requirements for performance Management found in the Management literature were fulfilled during the development of the Contract and its implementation. The outcomes of the experiment show substantial energy conservation – around 30 percent. The existing incentive structure was changed through the use of a performance Management Contract, and perverse effects that are mentioned in the literature were limited. The incentives established between the commissioning party and the Contractor triggered better performance and innovation, although balancing the responsibilities between the principal and the agent was demanding and time consuming. Energy performance Contracts are a useful piece of the sustainability puzzle, but tailor-made refinements are necessary.

    One of the most effective mechanisms for expanding full-service chain hotels, the Management Contract saw substantial changes in the early 1990s when the hotel industry ran aground and foundered. Both are alive and well but in changed circumstances. Owners have achieved greater bargaining power in Management Contracts due to substantial competition by a crowded field of operators. Lenders and asset managers have become parties to the negotiations, generally siding with owners' interests. Courts have ruled that Management Contracts are agency agreements with the operating company as agent for the owner, greatly circumscribing the operator's rights and sphere of activity. Moreover, the reentry of REITs as substantial hotel investors has reduced the number of properties available for Management Contract, because REITs are legally required to operate using leases. Nevertheless, operators that are willing to work with the new variety of activist owner still have substantial potential for growth, albeit mostly in reflagging existing properties.
