    Abstract:

    The article examines the interactions between German and British colonies which arose over Mixed Marriages between British citizens from the Cape colony and Mixed-race or African women living in German South-West Africa. When the German colonial administration banned Mixed-race relations and degraded the offspring of these Marriages during the years 1905-1907, the people affected tried to use their British citizenship to lodge complaints via the British Consul. Communications concerning the Marriages in question evolved on colonial and imperial level between the Cape colony and German South-West Africa as well as between the respective motherlands. The article addresses the interactions through the multi-vectorial analysis of a histoire croisee, thus offering a new, comparative view on the often discussed issue of Mixed Marriages in the German colony. It also focuses on the negotiations of the categories ‘white’, ‘native’ and ‘Mixed-race’ between colonies of different European empires, and points at different modes of implementation of racial policies in the Cape colony and German South - West Africa.

    Summary: Impressed by the prevalence of Italic dress ornaments in the earliest colonial graves of Pithekoussai, G. Buchner reasonably argued for widespread intermarriage between the first Euboean colonists and women from Italy. the paper pursues the implications of this hypothesis, and envisages how Mixed Marriages could well have resulted from Euboean precolonial contacts, notably with southern Etruria. the bilingual offspring of such Marriages would have played a leading role in the spread of alphabetic literacy, and in the sharing of other ideas between the first Western Greeks and the Italic mainland. At other frontiers of the early Greek world, parallel cases of widespread intermarriage are considered, leading to similar results: early Ionians in Caria, and Levantine master craftsmen settling among Cretans. Finally, returning to the West, I offer some fresh thoughts on the Aristonothos krater, seen in the context of several generations of intermarriage between Euboeans and Etruscans.     ABSTRAKSIPengertian perkawinan campuran dalam UU Perkawinan diatur dalam Pasal 57, yang berbunyi : ”Yang dimaksud dengan perkawinan campuran dalam Undang-undang ini ialah perkawinan antar dua orang yang di Indonesia tunduk pada hokum yang berlainan, karena perbedaan kewarganegaraan dan salah satu pihak berkewarganegaraan asing dan salah satu pihak berkewarganegaraan Indonesia.” Dalam perkawinan tercipta hubungan hukum di dalamnya yaitu antara suami istri, suami istri dan harta perkawinan, maupun hubungan orang tua dan anak. Dalam hal hubungan orang tua dan anak yang dilakukan dengan perkawinan campuran tentu berimplikasi terhadap akibat hukum bagi sang anak. Tujuan penelitian yang hendak dicapai adalah: Untuk  mengetahui dan memahami akibat hukum perkawinan campuran terhadap Hubungan Orang Tua dan Anak dan untuk mengetahui akibat hukum terhadap Hubungan Orang Tua dan Anak dalam hal terjadi perceraian pada perkawinan campuran. Metode pendekatan yang digunakan dalam penelitian  ini adalah pendekatan yuridis normatif. Penelitian dengan metode yuridis normatif adalah penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder belaka. Pada penelitian hukum normatif, bahan pustaka merupakan data dasar yang dalam penelitian digolongkan sebagai sebagai data sekunder. Dengan demikian jenis data yang diperoleh adalah data sekunder. Hal ini terjadi karena sifat dari penelitian yang dilakukan adalah berupa penelitian normatif, sehingga metode kepustakaanlah yang paling sesuai dengan sifat penelitian ini. Hasil penelitian, akibat hukum terhadap anak perkawinan campuran berdasarkan UU Nomor 62 Tahun 1958 adalah status kewarganegaraan anak mengikuti sang ayah, dan anak luar kawin mengikuti kewarganegaraan sang ibu. Sedangkan dalam UU Nomor 12 tahun 2006 status kewarganegaraan anak mengikuti ayah dan ibu sehingga memiliki kewarganegaraan ganda terbatas, karena pada saatnya harus memilih kewarganegaraan. Dalam hal terjadi perceraian pada perkawinan campuran, maka anak yang memiliki kewarganegaraan ganda tersebut pada saat berumur 18 tahun harus memilih kewarganegaraannya, lalu bagi anak yang belum dewasa perwalian ditentukan oleh proses pengadilan yang diputus oleh hakim.  Kata Kunci: Perkawinan Campuran, Orang Tua, Anak, Kewarganegaraan  ABSTRACTThe definition of Mixed Marriages in the Marriage Law is regulated in Article 57, which reads: "What is meant by Mixed Marriages in this Law is a marriage between two people who are in Indonesia subject to different laws, because of differences in citizenship and one of the foreign nationality and wrong party one party of Indonesian citizenship. " In a marriage a legal relationship is created in it, namely between husband and wife, husband and wife and marital property, as well as the relationship of parents and children. In the case of parent and child relationships carried out by Mixed Marriages certainly have implications for the legal consequences for the child. The research objectives to be achieved are: To know and understand the legal consequences of Mixed Marriages on the Relationship of Parents and Children and to know the legal consequences on the Relationship of Parents and Children in the event of divorce in Mixed Marriages. The approach method used in this study is a normative juridical approach. Research with normative juridical methods is legal research conducted by examining mere library materials or secondary data. In normative legal research, literature is a basic data which is classified as secondary data. Thus the type of data obtained is secondary data. This happens because the nature of the research conducted is in the form of normative research, so that the library method is the most appropriate to the nature of this research. The results of the study, the legal consequences of children of Mixed Marriages based on Law Number 62 of 1958 are the citizenship status of the child following the father, and the out of wedlock child following the mother's citizenship. While in Law Number 12 of 2006 the citizenship status of children follows the father and mother so that they have limited dual citizenship, because in time they must choose citizenship. In the event of divorce in Mixed Marriages, the child who has dual citizenship at the age of 18 years must choose his citizenship, then for minors the guardianship is determined by court proceedings decided by the judge.  Keywords: Mixed Marriage, Parents, Children, citizenshi

    ABSTRACT  In this Era of Globalization, people’s lives have increased greatly, the increasing number of nations has led to a country becoming open or having international relations with other countries. Mixed Marriages have traversed all corners of the country and society, information globalization, economy, transportation, cyberspace have increased mobility by migrating from one country to another, causing people to meet and communicate with various different ethnic groups, cultures, religions and the customs and communication habits allow Indonesian citizens (WNI) to carry out marriage with foreign citizens (WNA) so that what is called Mixed Marriages arises.
