    Abstract:

    Abstract Background March 2011 marked the 50th anniversary of the Single Convention on Narcotic Drugs. This legal instrument, the bedrock of the current United Nations based global drug control regime, is often viewed as merely a consolidating treaty bringing together the multilateral drug control agreements that preceded it; an erroneous position that does little to provide historical context for contemporary discussions surrounding revision of the international treaty system. Method This article applies both historical and international relations perspectives to revisit the development of the Convention. Framing discussion within the context of regime theory, a critique of the foundational pre-1961 treaties is followed by detailed content analysis of the official records of the United Nations conference for the adoption of a Single Convention on Narcotic Drugs and, mindful of later treaties, an examination of the treaty's status as a ‘single' convention. Results The Single Convention on Narcotic Drugs represents a significant break with the regulative focus of the preceding multilateral treaties; a shift towards a more prohibitive outlook that within international relations terms can be regarded as a change of regime rather than the straightforward codification of earlier instruments. In this respect, the article highlights the abolition of drug use that for centuries had been embedded in the social, cultural and religious traditions of many non-Western states. Further, although often-overlooked, the Convention has failed in its aim of being the ‘single' instrument within international drug control. The supplementing treaties developed in later years and under different socio-economic and political circumstances have resulted in significant inconsistencies within the control regime. Conclusion Having established that a shift in normative focus has taken place in the past, the article concludes that it is timely for the international community to revisit the Single Convention on Narcotic Drugs with a view to correcting past errors and inconsistencies within the regime, particularly those relating to Scheduling and traditional drug use.

    Abstract:

    Objective To investigate the clinical application and its tendency of Narcotic Drugs in one hospital.Methods A statistical analysis was undergone on the date of Narcotic Drugs application in one hospital during 2007 to 2009.Results Narcotic Drugs occupation ratio in all Drugs expends decreased yearly.The application of Morphine increases quikly,but this tendency was unstable.However,Morphine extended-release tablets took the first place in cancerous pain treatment,at the same time,application of Pethidine hydrochloride injection is still used very frequently,although its application showed downtrend year by year.Conclusion There is still non-rational use of drug in clinical Narcotic application,especially in cancerous pain treatment.

    Abstract:

    After gaining independence in 1991 the Republic of Tajikistan has encountered a whole number of social, economic and political problems, illicit trafficking of Narcotic Drugs represents the greatest danger among them that leads to respective legal, medical and social implications. Subject to the existing situation the Government of the Republic of Tajikistan has elaborated the own antidrug policy. Ratification of the United Nations Single Convention on Narcotic Drugs of 1961 by parliament of the country in 1996 has become the first and policy-making step. The purpose of the paper is to analyse the role of pharmaceutical law in implementation of the United Nations Single Convention on Narcotic Drugs of 1961 in the Republic of Tajikistan. The research objects are the normative legal documents of the Republic of Tajikistan on the subject of Narcotic Drugs control, which have been accepted by the parliament and government, and also by ministries and departments of the country in the context of the United Nations Single Convention on Narcotic Drugs of 1961. The analysis has shown that a number of legislative documents regulated the questions of the legal circulation control of Narcotic Drugs and providing drug abuse assistance have been accepted in the republic to execute the article 4 of the Single Convention. The controlled substances have been classified depending on application with legitimate aims, and also on the degree of health hazard. The licensing system of activity in the field of legal circulation of Narcotic Drugs, accounting and prescribed distribution has been created. Import and export of Narcotic Drugs are controlled by means of preliminary informing and release of permits valid for one occasion; the system of necessities calculation functions. Thus, the legislative base has been created with the purpose of implementation of the United Nations Single Convention on Narcotic Drugs of 1961 in the republic on the basis of pharmaceutical law.
