    Abstract:

    The question of the presence of Religious Symbols (e.g. crosses) in public space is an important topic in public discourse, leading to many political disagreements and legal disputes. What seems to be missing in the debate about crosses in public space (schools, universities, hospitals) is an assessment of the psychological consequences that these Symbols might have for Religious and non-Religious people visiting, studying and working in such places. The present experimental study examined the influence of Religious displays in a public university room on the psychological state of students: their self-esteem, as well as positive and negative affect. The study found that the Religious Symbol reduced negative affect among students who identify strongly with religion and those who frequently attend Religious ceremonies. The negative effects on non-Religious students were less pronounced. This result is discussed with reference to self-affirmation theory, environmental psychological theories and more recent findings on the social consequences of more subtle Religious exposures.

  • Effects of hijab as Islamic Religious Symbol on muslim consumer attitudes towards advertisements

    Abstract:

    Cues and Symbols are effective instruments to remind the consumers of their cultural values’ affiliations. Utilizing these Symbols in advertisement might unconsciously enhance information processing and consequently generate a favorable feeling. Hijab as a significant Religious cue for Muslims might peripherally influence advertisement evaluative efficacy among Muslim consumers. Utilizing Elaboration Likelihood Model (ELM), this research examined peripheral effect of Religious Symbol of hijab among Malaysian Muslims. A total of 120 UPM undergraduate students participated in four groups of experiments. They were randomly assigned to the four experimental groups. Participants in each group were exposed to four different TV commercial products portraying spokesperson with or without Religious Symbol of hijab. The results revealed that advertisements with Religious Symbol of hijab elicit positive attitude towards advertisement, attitude towards brand and purchase intention than advertisements without Religious Symbol of hijab. The main effect of Religious Symbol of hijab among different types of products is not contingent upon the type of product. This study also indicates that religiosity of the respondent has a significant moderating effect on the evaluation of an advertisement that portrays a spokesperson with hijab. That is, degree of religiosity is positively correlated with respondents’ attitude towards advertisement, attitude towards brand, and purchase intention. Furthermore, the influence of hijab as a peripheral cue on Muslims’ perceptions of advertisement even among highly involved respondents shows the significant role of this Islamic cue despite the thoughtful effort dedicated to advertisement messages. These findings challenge the mainstream of the ELM theory which posits that a favorable peripheral cue would not significantly influence the advertisement evaluation among highly involved subjects.

    Abstract:

    This article examines and discusses issues arising from bans of Islamic attires of women in public areas, schools and universities in High Contracting Parties of the European Convention of Human Rights (ECHR). This article revolves around the argument that the Islamic outfit is a Symbol of oppression on women’s rights or a Symbol of religion and faith. With the aim to comprehend and analyse the Western perspective on the prohibition of veils in contrast with the Islamic one and the reasons behind the issue, I set the theoretical background of this issue through the discussion of these ban-measures across some European states (i.e. France, Belgium etc.). The analysis of Articles of the ECHR relevant to the issue and particularly Articles 9(Freedom of religion) and 2 of Protocol 1 (right to education) , the citation of the related case law and my personal experience, help me answer whether the right of a Muslim woman to be educated, work as a teacher, believe and manifest her Religious views is being deprived by her decision to follow the Islamic dress-code or by prohibition-laws passed by European states and approved by the European court of Human rights (ECtHR). Through the study of the relevant case law, I realise that even the legislation itself has difficulties stipulating the idea of religion within the frame of the Islamic world. From one point of view, everyone is free to choose and manifest without discrimination his/her Religious views. On the other hand, someone’s Religious ideas should also respect other individuals’ Religious beliefs. For many people in the Western World, the idea of the Islamic veil is related to the violation of women’s rights and gives the image that these women are oppressed. However, through my personal experience on the issue and the study of the relevant academic sources, I can tell that many of these women decide to follow the Islamic dress code on their own. Their choice to defend their Religious views and their way of life should be recognised and be appreciated by the European countries and the ECtHR and not be violated. It is obvious that prohibition-laws do not benefit their rights but instead have as a consequence the violation of important human rights such as the right to education, teaching, expression, religion and non-discrimination.

    Spanish Abstract: Desde hace ya algunos anos la simbologia de caracter religioso ha sido un tema constante en los paises de nuestro entorno. Lo que en otras epocas no pasaba de ser una anecdota, con el comienzo del siglo XXI se ha hecho habitual y reclama la atencion de politicos y juristas. El Derecho se ha encontrado con un filon de problemas practicos a nivel nacional, regional e internacional. La complejidad de la materia, la disparidad de supuestos que se han planteado —y que se plantearan—, la importancia del estudio comparativo de este tema, permiten afirmar que estamos ante una especialidad de estudio juridico academico. Este trabajo se fundamenta en tres elementos basicos de estudio. El primer de ellos es el concepto y morfologia del simbolo religioso. Los otros dos elementos de estudio atienden al contexto en el que el simbolo se presenta: el “espacio” fisico o inmaterial, por un lado, y las “personas” portadoras de los simbolos religiosos, por otro. A partir de estos dos elementos —espacios y personas— se modulan diversas situaciones con caracteristicas singulares que determinan la especialidad de cada supuesto.English Abstract: For some years now, Religious Symbols have been a conflictive issue in Western countries. Legal and social issues concerning Religious Symbols were in the past but an anecdote. However, with the beginning of the XXI century they have become quite frequent and demand the attention of politicians and lawyers. The Law has faced with a vein of practical problems at the national, regional and international levels. The complexity of the matter, the disparity of cases that have been raised, the importance of Comparative law in this subject, etc. evidence that the legal study of Religious Symbols has become an specific field. This work is based on three basic elements of analysis. The first is the concept and morphology of Religious Symbol. The other two elements of study focus on the context in which the Symbol is presented: the physical or immaterial "space" and the "people" carrying Religious Symbols. From these two elements -spaces and people- various situations with unique characteristics determine the specialty of each issue.
