INTRODUCTION"Dark pools" are widely and increasingly complex platforms for securities Transactions that serve as alternatives to traditional public exchanges. They are essentially private stock exchanges that are owned and operated by large financial institutions. These private exchanges allow investors to complete securities Transactions without having to reveal their identities or Report their trading activities in real time.1 When an investor places an order to bu3^ or sell stock on a public exchange, the exchange typically makes information regarding that order publicfy available before the order is executed.2 As a result, when an investor places an order for a large block of shares on a public exchange, the trade ma}' cause market movements that are disadvantageous for the investor.3 Dark pools, in contrast, Report Transaction data only after a trade's completion.4 Thus, dark pools allow investors to trade without alerting their competitors, which minimizes the market impact of their actions.5 Executing trades "in the dark" can be beneficial to investors with large orders because these in- vestors may disguise their trading activity, which reduces the risk that other market participants, including predatory high frequency traders, will notice and take advantage of the investors' positions.6While the benefits to investors who trade "off-exchange" seem clear, these investors may be subject to predatory behavior within dark pools.7 This is largely due to the fact that dark pools are opaque and under-regulated.8 Although dark pools are subject to SEC regulations that impose various registration and operational requirements,9 those rules were created with the intent of "allowing] developing systems with low volumes to operate under a minimal regulator burden."10 As a result, dark pools are usually exempt from the more stringent quotation dissemination and fair access standards that these regulations impose on other types of alternative trading systems.11Furthermore, brokers operating dark pools are not required to disclose critical information about various aspects of the dark pools' operations to their customers - including the identities of the parties that trade on their systems, information about what types of orders are available on their platforms and the sources of their pricing data.12 Thus, it is nearly impossible for investors to know what really happens when their orders are filled within these private exchanges.13 Most brokers claim that they will only execute customers' trades in their dark pools when the best prices are available there.14 However, it appears as though they have little incentive to honor this guarantee, as no rule prohibits brokers from trading against their own customers within their dark pools.15 The majority of customer orders that are sent to the typical dark pool are filled there, but it is unlikely that a single dark pool could offer the best price available for such a high proportion of Transactions.16 If brokers were truly acting in their customers' best interests, then more trades that were initially routed to a broker's proprietary dark pool would eventually be executed elsewhere.17 In his recent book Flash Boys, Michael Lewis posits that traders may actually trade against their clients within their banks' dark pools, a practice that is not per se illegal.18 Similarly, while many financial institutions promote their dark pools as safe havens from high-frequency traders, they ma3^ in fact permit such high volume traders to bu3^ access to their dark pools.19 For example, in a recent complaint filed against Barclaj^s, New York Attorney General Eric Schneiderman alleged that Barclays operated its dark pool to favor high-frequency traders and "actively sought to attract them b}^ giving them systematic advantages over others trading in the pool" despite contrary representations to customers.20 Investors who utilize dark pools must simply trust that their brokers are not engaged in dishonest behavior, because they do not have access to information about the dark pools' operation beyond what the banks choose to reveal. …

Pemeriksaan pajak juga dilakukan bagi Wajib Pajak yang menggunakan fasilitas perbankan seperti Kartu Kredit. Direktorat Jenderal Pajak mengeluarkan kebijakan mengenai Kewajiban Pelaporan Data Transaksi nasabah pengguna Kartu Kredit. Peraturan tertulis dalam Peraturan Menteri Keuangan Nomor 16/PMK.03/2013 Tentang Rincian Jenis Data dan Informasi serta Tata Cara Penyampaian Data dan Informasi yang Berkaitan dengan Perpajakan. Pada peraturan tersebut, bank diwajibkan melaporkan segala data transaksi nasabah pengguna kartu kredit kepada petugas pajak yang paling sedikit memuat antara lain nama bank, Nomor Rekening Kartu Kredit, ID Merchant, nama merchant, nama pemilik kartu, alamat pemilik kartu, Nomor Paspor pemilik Kartu, Nomor Pokok Wajib Pajak pemilik Kartu, bulan tagihan, tanggal transaksi, rincian transaksi, nilai transaksi, pagu kredit. Pemberlakuan peraturan tersebut dirasa telah melonggarkan prinsip rahasia bank dan juga tidak melindungi data nasabahnya. Pembukaan data nasabah terkait perpajakan dikhawatirkan mengurangi kepercayaan masyarakat terhadap lembaga bank dan keadaan perekonomian di Indonesia kedepannya. Penelitian ini merupakan penelitian normatif dan penulis menggunakan metode Yuridis Normatif Sumber hukum primer yang digunakan penulis diperoleh dari perpustakaan, PDIH, dan Internet. Buku-buku ilmiah, Jurnal Hukum yang terkait, dan penjelasan Undang-undang yang terkait dalam penelitian ini sebagai sumber hukum sekunder. The enactment of the regulation was felt to have loosened the bank's secret principles and also did not protect its customers' data. The opening of customer data related to taxation is feared to reduce public confidence in bank institutions and the economic situation in Indonesia in the future. This research is a normative research and the author uses the normative juridical method The primary legal sources used by the author are obtained from the library, PDIH, and the Internet.
