    Gasheer gemeenskappe en mededingende aansoeke vir prospekteerregte ingevolge die "Mineral and Petroleum Resources Development Act" 28 of 2002 Die verskillende bepalings van die "Mineral and Petroleum Resources Development Act" 28 of 2002 ("die wet") omtrent die toekenning van gewone prospekteerregte of 'n preferente regte om te prospekeer word in hierdie bydrae bespreek. 'n Gewone prospekteerreg word deur die Minister, by aansoek aan 'n applikant, toegeken indien aan die vereistes van artikel 17 van die Wet voldoen word. Artikel 104(1) van die Wet daarenteen maak voorsiening vir die aansoek deur en toekenning van 'n preferente propekteerreg aan 'n tradisionele gemeenskap (soos omskryf in die wet) om op gemeenskapgrond te prospekteer. Hierdie bepalings het die grondslag gevorm van 'n ongeraporteerde beslissing van die Transvaalse Afdeling van die Hooggeregshof in Bengwenyama Minerals (Pty) Ltd v Genorah Resources (Pty) Ltd (39808/2007 (TPD) (18-11-2008). Die beslissing het gehandel het oor die bepaling van regsvoorkeur by mededingende prospekteeraansoeke wat na mekaar ten aansien van die Bengwenyama tradisionele gemeenskapsgrond ingedien is. 'n Poging is in die saak aangewend om ex post facto die een prospekteeraansoek in te klee as 'n aansoek vir 'n preferente prospekteerreg deur die tradisionele gemeneenskap. Daar word geargumeenteer dat die hof se beslissing rakende die verskil en verhouding tussen die twee soorte prospekteerregte en die toepassing van die "first come, first served principle" ingevolge artikel 9(1)(b) Wet juis was. Daar word voorts aangevoer dat die feite van die Bengwenyama Minerals beslissing die tekortkoming van die huidige artikel 104 van die Wet, om die belange van 'n tradisionele gemeenskap te beskerm, aantoon indien iemand anders aansoek doen vir 'n gewone propekteerreg. Daar word ook uitgewys dat die voorgestelde 2008 wysigings van die Wet ook nie ver genoeg strek om deelname in prospektering en benutting van mineraalbronne deur 'n tradisionele gemeenskap te verseker nie. Die slotsom word bereik dat die huidige wetgewing dringend gewysig behoort te word om die belange van tradisionele gemeenskappe te beskerm.

    Abstract:

    The Eastern Nile riparian countries are currently developing several reservoir projects to contribute to the needs for energy and food production in the region. In the absence of formal mechanisms for collaboration, the transboundary nature of the Eastern Nile basin makes water Resources Development challenging. The large seasonal and interannual variability of the river flow increases those challenges. This paper assesses the implications of water Resources Development in the Eastern Nile basin on water availability for hydropower generation and irrigation demands at country and regional levels, using simulation and scenario analysis methods. Twelve scenarios are used to test Developments of several dams and irrigation demands, Grand Ethiopian Renaissance Dam (GERD) operation options, and unilateral (status quo) versus integrated transboundary management of dams. A RIBASIM model that included 20 dams and 21 irrigation schemes was built, using a complete data set of 103 years at a monthly time step. Four indicators have been used for evaluating the performance of the system: hydroenergy generation (MWh=year), reliability of irrigation supply (%), reservoir net evaporation (106 m3/year), and flow regimes of rivers (m3/s). The results show that in case of managing the system in an integrated transboundary manner and without new irrigation Development projects, GERD would increase the hydroenergy generation in Ethiopia by + 1,500% and in Sudan by + 17%, with a slight reduction in Egypt of -1%. Supply reliability of existing and planned irrigation schemes in Sudan would not be practically influenced by the GERD, but the reliability will be reduced by about 8% when upstream Development and new irrigation expansion materialize. Full Development of the Eastern Nile basin would reduce the irrigation supply reliability in Egypt to 92% compared to the base scenario (100%). Compared to integrated management, unilateral management would increase the hydroenergy generation in Ethiopia (+16%), increase the rate of evaporation losses in the basin (+15%), and reduce the irrigation supply reliability in Sudan after full Development of dams and irrigation projects (-10%).     Abstract:

    Serious environmental problems are emerging in the River Nile basin and its groundwater Resources. Recent years have brought scientific evidence of climate change and Development-induced environmental impacts globally as well as over Egypt. Some impacts are subtle, like decline of the Nile River water levels, others are dramatic like the salinization of all coastal land in the Nile Delta – the agricultural engine of Egypt. These consequences have become a striking reality causing a set of interconnected groundwater management problems. Massive population increase that overwhelmed the Nile Delta region has amplified the problem. Many researchers have studied these problems from different perspectives using different methodologies, following different objectives and, consequently, arrived at different findings. However, they all confirmed that significant groundwater salinization has affected the Nile Delta and this is likely to become worse rapidly in the future. This article presents, categorizes and critically analyses and synthesizes the most relevant research regarding climate change and Development challenges in relation to groundwater Resources in the Nile Delta. It is shown that there is a gap in studies that focus on sustainable groundwater Resources Development and environmentally sound protection as an integrated regional process in Nile Delta. Moreover, there is also a knowledge gap related to the deterioration of groundwater quality. The article recommends further research that covers the groundwater Resources and salinization in the whole Nile Delta based on integrated three-dimensional groundwater modelling of the Nile delta aquifer.

    This article presents a critique of the ‘high skills’ argument which, in the international literature, presents a high skill strategy as an adjunct and necessary condition for the successful expansion of human Resources Development (HRD) alongside social market institutions and ‘joined up’ policy 1. For a developing country such as South Africa, with a large proportion of its populace unemployed and possessing very low levels of skill, a privileging of high skills is inappropriate as the single focus of HRD. The article argues the case for a multi‐pronged HRD approach, comprising a joint high‐skill and intermediate‐skill strategy on the supply side, underpinned by a demand‐driven strategy that seeks to stimulate large‐scale labour‐absorbing employment growth and is supported by appropriate inputs of training for the unemployed. And finally Human Resources Development Of Transportation (BPSDMP) Ministry of Transportation in coordination with the Minister of maritime has ordered six (6) units training ship cadets that each measure approximately 1200 GT (Gross Tonnage) with a capacity of 300 people, which is built in harbor and the domestic industry by PT Steadfast Marine Pontianak. Coordinating Minister of Maritime also said that with the training ship would be easier for BPSDM to improve the quality of education Midshipman cruise who were taking education time official the country especially in the field of shipping, including also can help private schools and shipping academy that did not have a training ship for come to enjoy it.
