Thus, the provisions of Articles 224-2244 from the Criminal Procedure Code of 1968 shall be repealed and the new criminal procedural provisions will apply from this time forth.The New Criminal Procedure Code regulates issues concerning the Undercover Investigator in Title IV – Evidences, means of evidence and evidentiary procedures, within the Chapter IV relating to special surveillance or research methods, consecrating to this institution three articles (Articles 148-150 of the New Criminal Procedure Code).

The Role of Undercover Investigators and Confidants in Criminal Proceedings

Chair of Criminal Law., 2017Co-Authors: Krznar IvanaAbstract:Predmet ovog rada je uloga prikrivenih istražitelja i pouzdanika u kaznenom postupku. Iz samog naziva prikrivenog istražitelja možemo zaključiti da se radi o tajnim radnjama, tzv. prikrivene policijske radnje. U radu se navode njihove definicije, a detaljnije se obrađuje postupak uporabe. Rad je koncipiran na način da prvo prikazuje povijesne začetke prikrivenih radnji, a kako bi takve radnje bile uspješne posebnu pozornost treba posvetiti planiranju i provođenju operacija te odabiru prikrivenog istražitelja. I prikriveni istražitelji i pouzdanici moraju dobrovoljno pristati na svoje uloge kako bi cilj bio uspješno ostvaren, a važno je spomenuti da njihov identitet mora biti strogo čuvan i nepoznat javnosti kako bi se takva radnja uspješno provela. Nadalje je obrađeno poticanje osumnjičenika na počinjenje kaznenog djela, kao i važnost svjedočenja prikrivenih istražitelja i pouzdanika. Na kraju rada upoznaje se s posljedicama prikrivenih istražitelja nakon obavljanja takvih radnji što je potkrijepljeno i primjerima iz prakse. Uporaba prikrivenih istražitelja i pouzdanika pripada posebnim dokaznim radnjama pa je jasno da će do njihove uporabe doći samo u određenim slučajevima, kada zaista postoji potreba za njima kako bi se uspješno proveo kazneni postupak.The aim of this paper is to describe the role of Undercover Investigators and confidants in the criminal proceeding. From the very name of the Undercover Investigator, it can be concluded that the Undercover action is here the main subject, i.e. theso-called "Hidden police actions“. The paper describes their definitions, and the usage process is further elaborated. This research is conceived in a way that the historical inception of the disguised actions is first shown, and in order for such actions to be successful, special attention should be paid to planning and carrying out operations and selecting a Undercover Investigator. Both, Undercover Investigators and confidants, must accept their roles voluntarily in order to achieve the goal and it is relevant to mention that the identity of the Undercover Investigators and confidants must be strictly protected and kept secret from the public, so that such actions can be completed successfully. Furthermore, encouraging the suspect to commit the offense is also elaborated, as well as the importance of Undercover Investigators and confidants testimony. At the end of the paper, the consequences of the Undercover Investigators work are shown, and also evidenced by examples from practice. The use of Undercover Investigators and confidants belongs to special measures of inquiry, so it is clear that they will only be used in certain cases when they are really needed for the successful prosecution of a criminal proceeding

the possibilities of engagement of Undercover Investigator in the detection of criminal acts of terrorism
Vojno delo, 2010Co-Authors: Nincic željkoAbstract:In addition to various other forms of threats, for some time now the world stage is 'richer' for yet another - terrorism. In recent times, terrorism is more present among the sources of threats to the state, and by way of showing the consequences and causes, it is far more visible and cruel. Therefore, the modern society faces constant anxiety because of new terrorist attacks on one hand, and on the other hand, constant efforts to find an appropriate ways for its suppression. As a negative phenomenon, terrorism is a subject of response both on the national and international levels, where attempts are made to unify a front to oppose this socially unacceptable phenomenon. This requires a high degree of mobilization of all social forces in its suppression. Organized approach to its opposition is particularly significant, through professional and thorough implementation of anti-terror procedures, with special emphasis on those means of opposition that were until recently out of focus or without legal basis for the implementation, but which can achieve outstanding results. In that sense, infiltration methods have special significance, as sole methods whose implementation from 'within' could reach the very top of the organization. In this case, the use of Undercover Investigator is especially important. Starting with the actuality of terrorism as a phenomenon, the paper highlights the problem of universal definition of terrorism, and points to its origin and development, types and forms of manifestation, efforts of the international community in its suppression, as well as the importance of engaging the Undercover Investigator in the detecting, preventing and proving the acts of terrorism. Methodology of selection, preparation and 'insertion' of the Undercover Investigator into a terrorist organization is particularly emphasized.
