    Abstract:

    The resurgence of the victim, as a topic of interest for criminological sciences and criminal law, has caused the need to question whether traditional criminal justice models are adequate to satisfy their interests, considering that it is a protagonist of the criminal conflict. Collecting some restorative experiences and with the support of the most modern Victimology, the criminal justice systems stop focusing only on the punishment of the offender and open themselves to the adoption of restorative justice programs, which recognize in the victim a subject holder of the right to the repair of the damage.El resurgimiento de la víctima, como sujeto de interés para las ciencias criminológicas y el derecho penal,ha provocado la necesidad de cuestionarse si los tradicionales modelos de justicia penal son adecuados para satisfacer sus intereses, considerando que se trata de un protagonista del conflicto penal. Recogiendo diversas experiencias restaurativas y con apoyo de la victimología más moderna, los sistemas de justicia penal dejan de enfocarse solo en el castigo al infractor penal y se abren a la adopción de programas de justicia restaurativa, que reconocen en la víctima un sujeto titular del derecho a la reparación del daño

    Abstract:

    From the postulates of “Developmental Victimology”, this articleaims to address the reality of the reformed criminal protection of theminority of age as a victim of crimes. Legislative schizophrenia, existing inthis area, within the framework of the Spanish Penal Code, shows a driftfar removed from the paradigm of “Developmental Victimology” that allows to understand the victimization of minors, and the different treatment, also legal-penal to be adopted in such cases.A partir de los postulados de la Victimología Evolutiva, el presente artículo pretende abordar la realidad de la tutela penal reformada de la minoría de edad en su condición de víctima de delitos. La esquizofrenia legislativa, existente en esta materia, en el marco del Código Penal español evidencia una sinrazón muy alejada del paradigma de la Victimología Evolutiva que permite comprender la victimización de menores de edad, y el diferente tratamiento, también jurídico-penal a adoptar en esos supuestos

    Abstract:

    Criminalistic study of a victim of the crime (criminalistic Victimology) Abstract This presented thesis puts at the forefront a victim of the crime and its importance within criminalistic Victimology, the study about a victim of the crime. The role of the victim is important both at the beginning of the criminal offence as well as during its duration. The victim is also important factor at the notification of the criminal offence, its investigation and at the court hearing of the criminal offence. In this thesis, I put at the forefront the relationship between a victim and an offender, which may exist in such a superficial range or on the contrary they may be really close to each other. There is also outlined in which extent the victim is participating on the creation of tracks, or if is their bearer. The thesis deals with a victim as a notifier of criminal activity - which reasons that lead to its (non-) notification. The major part of this thesis shall be described as part of a victim on the investigation of a criminal offence, mainly its role during the interrogation of itself, but also during the confrontation and the recognition. Another non-less important aspect of this thesis is help for victims of the criminal offence, as well as financial, social and psychological. At the end, the legal regulation..

    Kriminalistické učení o oběti trestného činu (kriminalistická viktimologie) Abstrakt Předkládaná diplomová práce staví do popředí osobu oběti a její význam v rámci kriminalistické viktimologie, učení o oběti trestného činu. Role oběti je významná jak při zrodu trestného činu, tak i během jeho samotného průběhu. Oběť ale zároveň vystupuje i jako důležitý činitel u oznámení tohoto činu, jeho vyšetřování a také u jeho soudním projednání. Do popředí jsme v této práci postavili vztah oběť - pachatel, který může existovat mezi dotyčnými v zcela povrchním rozsahu, anebo naopak si mohou být dotyční opravdu blízcí. Dále je zde přiblíženo, v jakém rozsahu se oběť podílí na vzniku stop, popř. zda je jeho nositelem. Práce se také zaobírá obětí jako oznamovatelem trestné činnosti - jaké důvody ji vedou k jejímu (ne)oznámení. Za stěžejní část této práce můžeme označit podíl oběti na vyšetřování trestného činu, zejm. její roli během výslechu jí samotné, ale také během konfrontace či rekognice. Dalším ne méně významným aspektem této práce je pomoc obětem trestného činu, a to jak pomoc finanční, sociální, tak i pomoc psychologická. V závěru je pak rozebrána právní úprava postavení oběti a dále poškozeného.     With the constitutional reforms of 2008 and 2011 in Mexico, the victim has acquired a new role in the adversarial criminal procedure, situation in which played an important role the Victimology, do criminal and the maximization of human rights; by what the victim who had been excluded today is considered as procedural an important catalogue of rights deriving from the national legislation and international treaties, so it is emphasized the reparation of the damage and implemented restorative justice, placing the elements necessary for the no-victimation.Con las reformas constitucionales de 2008 y 2011 en México, la víctima ha adquirido un nuevo rol en el procedimiento penal acusatorio, situación en la que jugaron un papel importante la Victimología, el Garantismo Penal y la maximización de los derechos humanos; por lo que la víctima que había sido excluido hoy es considerada como sujeto procesal con un importante catálogo de derechos derivados de la legislación nacional y los tratados internacionales, por lo que se enfatizado la reparación del daño e implementado la justicia restaurativa, colocando los elementos necesarios para la desvictimación

    Abstract:

    Most discussions of environmental crime typically refer to environmental degradation at the macro level, such as the large scale pollution of rivers or oceans, where there is no clear victim. This paper reports on a study which examined environmental crime from a more micro, place-based perspective, namely incidents that occur on farms where individual farmers are victims. Almost half of the 1926 respondents to a nation-wide survey of Australian farmers reported experiencing some type of environmental harm over the previous two years. Three case studies then examined whether farmers defined such harms as environmental ‘crime’. Many but not all harms were described as crimes and there was divergence as well as convergence with formal law. In some areas, farmers' appreciations led formal proscriptions. Where farmers ‘lagged’ behind, contextual reasons were provided for the exceptions. All actions leading to harm were considered criminal if intentional, while accidental acts were not. Negligence was also used to define some actions as environmental crimes. The findings add to the growing literature on Green Victimology and the need to understand informal norms and appreciations of law as well as formal impositions and structures.
