Adjudicator determines records containing information about an applicant s birth mother should be released to the applicant
2011Co-Authors: Wayne WoodAbstract:An Adjudicator with the Office of the Information and Privacy Commissioner has determined that Alberta Children and Youth Services should release information about an individual’s birth mother to him. The individual requested records in the custody or control of the Public Body about his birth mother, who was deceased. The Public Body provided information regarding the Applicant’s grandparents, on the basis that they had been deceased for more than 25 years, but refused to provide information about the birth mother, because she had not been dead for 25 years. Following an inquiry into the matter, Adjudicator Teresa Cunningham determined that the evidence established that the factors weighing in favor of disclosing the information in the records rebutted the presumption that it would be an unreasonable invasion of a third party’s personal privacy to do so. She found that the fact that the records contained the Applicant’s own family history and family medical history weighed in favor of disclosure. She also found it relevant to her decision that any remaining privacy interests of the Applicant’s mother were diminished, and that there were no other individuals who had privacy interests in the information. The Adjudicator ordered the Public Body to release the birth mother’s information to the Applicant.

Adjudicator determines an organization lacks standing to make complaint against the workers compensation board
2010Co-Authors: Wayne WoodAbstract:An Adjudicator with the Office of the Information and Privacy Commissioner has determined that an organization that launched a complaint against the Workers’ Compensation Board lacked standing to bring a complaint regarding the collection of personal information. An organization requested a review of the WCB’s practices of collecting earnings information from principals and partners of businesses when they file annual returns. Adjudicator Teresa Cunningham found the complainant lacked standing under the Freedom of Information and Protection of Privacy Act (FOIP) to make a complaint regarding the collection of personal information, as FOIP enables only those individuals who believe their own personal information has been collected, used or disclosed contrary to Part 2 of the Act to request review by the Commissioner. The Adjudicator noted that in the event she was wrong regarding the identity of the complainant, and the complaint had been made by a partner of the organization regarding the collection of his own personal information, she found there was no evidence to establish that his personal information had been provided to, or collected by, the Public Body.

Adjudicator finds edmonton police service properly withheld some records and orders the release of other records
2010Co-Authors: Wayne WoodAbstract:An Adjudicator with the Office of the Information and Privacy Commissioner has ruled that the Edmonton Police Service properly withheld some records that had been requested by an Applicant. The Applicant had requested the entire file relating to the investigation of a motor vehicle accident. EPS provided the Applicant with a portion of the records, but withheld other records under four sections of the Freedom of Information and Protection of Privacy Act (FOIP). Adjudicator Lisa McAmmond found that EPS had properly withheld some of the records, but ordered the Police Service to release the remaining records or portions of the remaining records. Adjudicator determines edmonton police service properly withheld some information but did not properly respond to part of an access request
2010Co-Authors: Wayne WoodAbstract:An Adjudicator with the Office of the Information and Privacy Commissioner has determined the Edmonton Police Service properly withheld information that had been requested regarding extensions of investigations of alleged misconduct of officers with the Service. The Adjudicator also found that the Service did not properly respond to part of the applicant’s access request. The Applicant requested the names of officers involved in certain allegations, the particulars of the charges against them, and the written submissions made to the Edmonton Police Commission explaining delays in dealing with the investigations and the reasons for requesting time extensions to complete the investigations. The Police Service withheld all of the information, citing certain sections of the Freedom of Information and Protection of Privacy Act (FOIP). Following an inquiry into the matter, Adjudicator Wade Riordan Raaflaub determined that the Public Body had properly withheld the names of the officers in question, as those names were readily available in an online report. He also determined that EPS did not properly respond to the request for the particulars of the charges against the officers, as the publicly available report did not contain the information. Riordan Raaflaub also ruled that the Public Body properly withheld written submissions to the Police Commission, as they could reveal the substance of deliberations of a meeting of the Commission that had been held, and that was authorized to be held, in camera.

Adjudicator determines that possible collection and disclosure of personal information would have been authorized
2010Co-Authors: Wayne WoodAbstract:An Adjudicator with the Office of the Information and Privacy Commissioner has determined that the Board of Trustees of Edmonton School District NO.7 had the authority to disclose information about a child to the Edmonton and Area Child and Family Services Authority (Region 6), and that Child and Family Services had the authority to collect the personal information. An individual complained that the School District had disclosed personal information about the Complainant’s children to Child and Family Services without proper consent. Following two inquiries into the matter, Adjudicator Lisa McAmmond found that there was insufficient evidence as to whether recorded personal information had been disclosed and collected. However she ruled that, if the School District had disclosed recorded personal information and if Child and Family Services had collected recorded personal information, the disclosure and collection would have been authorized under sections 33, 34 and 40 of the Freedom of Information and Protection of Privacy Act (FOIP).

Social Science Research Network, 2014Co-Authors: Efrat ArbelAbstract:This article examines Canadian refugee law cases involving domestic violence, analyzed through a comparison with cases involving forced sterilization and genital cutting. Surveying 645 reported decisions, it suggests that Canadian Adjudicators generally adopted different methods of analysis in refugee cases involving domestic violence, as compared with these other claims. The article argues that Canadian Adjudicators rarely recognized domestic violence as a rights violation in itself but, instead, demonstrated a general predisposition toward finding domestic violence persecution in cultural difference. That is, Adjudicators tended to recognize domestic violence claimants not as victims of persecutory practices but rather as victims of persecutory cultures. The article suggests that this approach establishes incorrect criteria by which to evaluate domestic violence claims, for two main reasons. First, this approach does not accord due weight to complex factors besides culture that make women vulnerable to persecution in domestic settings. Second, this approach erects legal and conceptual barriers for women who cannot authentically narrate their experience through the script of cultural vulnerability or who cannot present as “victims of culture”. The article posits that characterizing the violence suffered by refugee women as a product of culture does more than erect barriers for refugee claimants; it also operates as a protective device that suppresses the commonality of domestic violence across cultures and elides its domestic prevalence. The article concludes by suggesting that this approach replicates problematic assumptions about gender violence and gender difference that make it harder to address domestic violence both abroad and at home.
