This chapter focuses on computer network attacks—in particular, the aforementioned physical, electronic, and logical factors involved in cyber warfare, as well as reactive and proactive actions and the element of time. To drive these points home for the reader, the chapter delves into the different phases of the attack process, from reconnaissance, scanning, accessing systems, and escalating privileges, to exfiltrating data, assaulting the system, sustaining access, and obfuscating any traces that might be left behind. Given that even strictly physical warfare, in the sense of boots on the ground, depends a great deal on technologies, these things are vulnerable to cyber attack. Support for physical operations depends on supplies being delivered properly, soldiers being moved from one place to another on a tight schedule, communications functioning, and any number of other factors. On the other side of the coin, cyber warfare activities are very vulnerable to physical effects. If communications lines are severed, power is unavailable, environmental conditions cannot be maintained, or any of a number of other conditions cannot be met, the relatively fragile computer systems and infrastructure become so much dead weight. Physical warfare can affect or be affected by cyber warfare attacks. When the physical component is ignored in cyber warfare, one potentially loses a large portion of the entire picture. Cyber warfare is indeed a distinct dimension of warfare, but isolating it from the other dimensions renders its capabilities incomplete.

International Review of the Red Cross, 2002Co-Authors: Michael N SchmittAbstract:This chapter examines the application of the jus in bello, or international humanitarian law (IHL), to information operations, specifically computer network attacks (CNA). Discussion centres on the use of CNA in the context of an international armed conflict, although the conclusions would apply equally to a non-international armed conflict for those customary rules of IHL which extend into that form of conflict. It begins by addressing the threshold issue of whether IHL applies at all to CNA. Concluding it does, the chapter goes on to explore the key aspects of IHL relevant to CNA operations, especially the rules which prohibit the use of indiscriminate weapons and those governing targeting. Of particular note is the discussion of the notion of “attack” in the CNA context. Ultimately, it is concluded that CNA presents a particular problem for application of the traditional IHL.

In a matter of months, US Forces successfully routed, with almost no hostile fire casualties, a battle-hardened and ruthless adversary in a combat environment that frustrated the potent Soviet army for a decade. Operation ENDURING FREEDOM follows close on the heels of Operation ALLIED FORCE, the 1999 NATO campaign that defeated, without friendly casualties, the Yugoslav military. In that conflict, as in the most recent one, exploitation of technological wherewithal proved a decisive factor in determining the victor.

Analysis centers on the United Nations Charter’s prohibition of the use of force in Article 2(4), its Chapter VII security scheme, and the inherent right to self-defense codified in Article 51. Concluding that traditional applications of the use of force prohibition fail to adequately safeguard shared community values threatened by CNA, the Chapter proposes an alternative normative framework based on scrutiny of the consequences caused by such operations.

Comparative Strategy, 2016Co-Authors: Christopher WhyteAbstract:ABSTRACTThe use of coercive instruments of statecraft and military power to affect changes in strategic behavior is a common feature of international politics. Recently, a variety of state and sub-state actors have attempted to utilize cyber instruments of disruption and intrusion to bring about favorable outcomes. This article notes that digital instruments for coercion offer limited potential for effective compellent effect in world affairs. Nevertheless, as the case of North Korea's 2015 hack and (attempted) manipulation of Sony demonstrates, coercion using cyber weapons of intrusion and disruption is possible under particular conditions. In describing these conditions, I argue that the limits of cyber coercion should be seen more as a function of relevant social and institutional context than of the current state of technological possibilities. Technology certainly determines parameters of coercive interaction between actors, but success—and thus most determinants of strategic decisions surrounding cy...
