    Abstract:

    Since the founding of New China in 1949, the Land Law system with Chinese characteristics has been formed based on various practices, inter alia, the evolution of the rural Land Law system from the agrarian reform to the cooperative and people’s communes and further to the household contract responsibility system, which made historical contributions to the development of Chinese social economy. However, with the development of the practices and the deepening of the reform, China’s Land Law system is facing great challenges under the new circumstances. Although many differences exist between English Land Law and Chinese Land Law in the areas of legal form, the regulated objects and contents, English Land Law can provide some beneficial enlightenment to China’s Land Law reform. Particularly, the “paradox of English Land Law,” which presents the way how the English Land Law, as the Law adjusting the basic property relations with many traditional factors, responds to the process of social and economic development with leaps and bounds.

    Abstract:

    In view of the current severe situation of illegal Land use in China, it is of great significance to explore the impact of the evolution and promotion of Land Law enforcement effectiveness, which will improve China's Land Law enforcement system and effectively curb illegal Land use. This paper explains the changes and enhancements of the effectiveness of Land Law enforcement since the implementation of China's National Land Supervision System in terms of the deterrence, difficulty, and strength of Land Law enforcement, and explores the role of Land Law enforcement effectiveness in changing illegal Land use behaviors from a theoretical level. Then, a corresponding empirical test was carried out using the provincial panel data of MainLand China from 2007 to 2016. The results show that the increase in Land Law enforcement deterrence and strength will help reduce the number of illegal Land use cases, but it will drive the Lawbreakers to "commit major cases in desperation", leading to the increase of the degree of illegal Land use; and with the decrease of Land Law enforcement difficulty, the degree of illegal Land use will be significantly reduced. At the end of this paper, several policy suggestions are put forward to effectively curb the illegal Land use from the perspective of improving the Land Law enforcement system and enhancing the effectiveness of Law enforcement.

    In 1925, EngLand enacted substantial legislation that recast the existing Land Law, and which provided the framework on which modern Land Law was developed for more than seventy-five years. The essential framework remained intact until the enactment of the Land Registration Act 2002, which replaced, and substantially modified, the Land Registration Act 1925. But while the Land Registration Act 2002 is expected to be an important piece of legislation relating to Land ownership in EngLand, the 1925 legislation will still provide a good deal of the theoretical underpinning of the subject. This chapter discusses the main strategies of the Land Registration Act 1925, focusing on its effect on unregistered Land. It first describes Land Law after 1925 before turning to legal estates, legal interests in Land, equitable rights, Land charges registration under the Land Charges Act 1925, unregistrable interests, and classification of interests.
