    Abstract:

    The concept of the ‘Legal Official’ is one of the most under-theorised yet critical explanatory elements of modern analytical jurisprudence. However, it is also a term beset by conceptual uncertainty and functional ambiguity. In fact, as commonly employed by analytical theorists, it seems to function merely as a boot-strapping device, relinquishing the need to justify the kind of pre-Legal hierarchy or constitutional authority commonly found at the state level. This reliance on Officialdom is particularly problematic bearing in mind that the lack of any such hierarchies at the international level has been the cause of constant scepticism as to the reality and efficacy of international law as a Legal system.     Abstract:

    This chapter provides an overview of the concepts and arguments of Carl Schmitt (1888–1985)—Hitler’s chief Legal Official and an international law apologist for Nazi aggression — that have gained the most purchase in contemporary international Legal discourse, primarily international Legal theory. The chapter critically engages with a select group of scholars who have deployed Schmitt in contemporary international Legal theory. These are: Martti Koskenniemi, Eric Posner and Adrian Vermeule, Paul Kahn, and Nehal Bhuta. Lastly, the chapter concludes with some observations about what the use of Schmitt in contemporary international Legal theory may tell one about the state of the discipline, its fault lines, and anxieties.

    Proceeding from validation of the Official documents,the digital signature based on QR code technology is proposed for the related Official documents to integrate the current functional management systems. The validation of truth,integrity and non-repudiation of the Legal Official documents can be realized by the simple interaction of smart phone and other smart equipments. It can meet the requirement of information encryption transmission. The model selection of QR code generation,security demonstration and gain superiority related to validation are introduced.

    Abstract:

    The article investigates the most important trends in the formation of business papers by Oleksa Vlyzko (1908–1934). This Ukrainian writer belonged to the literary groups “Nova Heneratsiya” (“The New Generation”), “Molodnyak” (“The Offspring”), Ukrainian Union of Proletarian Writers and combined the elements of Vanguardistic and Neo-Romantic poetics into one. The aim of proposed work is determination of the standards of Ukrainian Legal (Official-business) style that are represented in the documents of the man of letters who gravitates to experiments in imaginative texts. The topicality of the research consists in the analysis of the manifestations of the author’s individuality in such style which is often treated as the kind of unemotional and even bureaucratic discourse. At the same time the conciousness of the follower of the play in the belles-lettres may be ‘programmed’ to expressive account in another spheres. Vlyzko’s vision of a document is interpreted in purely linguistic, biographical and textological aspects. The first of them lets to discern the emotional lexical and phraseological means, methapors, Russisms with some connotations in business papers (халтура ‘potboiler’; <...> хочу щоб <...> не махали перед моїм носом, як перед носом осла оберемком сіна “I want that <...> anyone shouldn’t wave in front of my nose like he should wave with a bottle of hay in front of a nose of a donkey”; єрунда ‘rubbish’ (Russian)). As biographical materials show, Oleksa Vlyzko liked various provocations and pranks. Those ways of behaviour were the notable factors of his linguistic communication with editors and state institutions. Finally, the rough copies of writer’s documents contain many corrections, especially fixed components and words that are crossed out. This peculiarity also testifies to the evolution of Vlyzko’s special communicative etiquette and significant idiostyle in Ukrainian Legal (Official-business) style. The innovatory material of the research includes the sources from Manuscript Institute at Volodymyr Ivanovych Vernadsky Ukrainian National Library.

  • Citizenship for Sale: Passports of Convenience from Pacific Island Tax Havens

    Abstract Pacific Island tax havens have apparently collected $153,450,000 from (mostly ethnic Chinese) purchasers of passports. This paper considers the evolution of passport sales in Tonga, Samoa, the Marshall Islands, Vanuatu and Nauru and internal and international opposition to them. Tension exists between different conceptions of citizenship within the world–system. Sales reflect classical liberal, individualistic, free market conceptions of citizenship. Opponents invoke both conservative and democratic conceptions of citizenship. This paper favours democratic solutions to many problems sales create. Sales schemes involve secrecy and corruption which attenuates following exposure by media, opposition politicians, watchdogs and crusaders against international terrorism. Pacific Island havens currently have no Legal, Official passport sales schemes, but this paper demonstrates that sales probably continue.
