    Abstract:

    This study is aimed to empower traditional herbs producer and help Legal Protection of Indonesian traditional medicines, implementing Participatory Research and juridical-sociological approaches. Data were collected through literary, questionnaire, interview and Focus Group Discussion. The first year study revealed that Herbal Producer Association worked with all members, persuading government offices to get product certification and effective trademark licenses. In the second year study the researchers and Producers Association trained and facilitated vendors to endorse trademark, label registry, and markets shares. Producers maintain traditional medicine management, because product certification is hard to achieve. Penelitian ini bertujuan untuk memberdayakan produsen jamu/OT dan membantu perlindungan hukumnya, dengan memanfaatkan pendekatan penelitian partisipatoris dan sosiologis yuridis. Data dikumpulkan dengan literatur, kuesioner, wawancara dan Focus Group Discussion (FGD). Pada tahun pertama organisasi gabungan pengusaha jamu (GP Jamu) bersama-sama dengan seluruh anggotanya mendorong pemerintah untuk perolehan sertifikasi produk izin edar dan merek secara efektif. Pada tahun kedua, peneliti dan gabungan pengusaha jamu melakukan pelatihan guna perolehan izin edar, pendaftaran merek, dan peningkatan pemasaran. Para pengusaha jamu tradisional perlu terus menerus didampingi karena perolehan izin edar terkesan sulit.

    Abstract:

    Indonesia's Legal Protection is inadequate for children as witnesses of victims of criminal acts of decency in the criminal justice process. The objectives of the research include: To analyze the implementation of Legal Protection for children as witnesses of victims of crime of decency in the criminal justice process at the Kendal District Court, To analyze the treatment of children as witnesses to victims of criminal acts of decency during the criminal justice process at the Kendal District Court and for analyzing the obstacles and solutions in providing Legal Protection to children as witnesses of victims of crime of decency in the criminal justice process at the Kendal District Court. In this study, a sociological juridical approach is used, an approach used in dealing with problems discussed based on applicable regulations and then linked to the reality that occurs in the community. Based on the research, the conclusion is: Implementation of Legal Protection for Children as Witnesses to Victims of Crime of Decency in the Criminal Court Process against children as victims of decency crimes in the form of Legal Protection in the form of: Restitution and Compensation, Counseling, Medical Assistance, Legal Aid and Information Providing. Treatment of Children as Witnesses to Victims of Criminal Actions of Decency during the Criminal Court Process Law enforcement officials still treat women victims of child sexual abuse as objects, not subjects that must be heard and respected for their Legal rights and Constraints and Solutions in the Kendal District Court. The victim feels traumatized as a result of this case in providing testimony at the trial and the solution and solution to these obstacles is that victims of criminal acts of sexual immorality continue to be given support from both family and community

    Abstract:

    This study examines the Legal Protection of patient rights in health services in Indonesia. The aims of the study are to find out how the Legal Protection of patients as consumers in receiving health services and what factors affecting the Legal Protection of patients’ rights in receiving health services. The method employed in this study is a normative study by analysing data obtained from library. The data gathered are in form of secondary data. All the data collected are analysed descriptive qualitative. The problem raised herein is Law Number 44/2009 Concerning the Hospital is not fully well implemented. The results showed that there were many factors influent the effectiveness of Law Number 44/2009 above. The conclusion drawn up that the malpractice in terms of providing medical care may cause disharmony between physicians and patients; the facilities and infrastructures in the health care provided for in the hospital do not support the patients’ rights to obtain health care. Any responsibility borne to the hospital may only in the case of the patients suffered from the malpractice. Should this happen the patients can submit any formal complain to the Court

  • Notary Role in Making Using Standard Contract Technology Information in The Framework of Legal Protection of Small and Medium Enterprises (SMEs)

    Abstract:

    The purpose of this research is; (1) to analyze the role of the notary in contract manufacturing standards using technology information in a business transaction that is carried out by SMEs, and (2) to analyze the obstacles and solutions contract manufacturing standards using technology information in providing Legal Protection to SMEs. Researchers use various types of data in the study, such as; (1) primary data, (2) secondary data, and (3) the data tertiary. The three types of data must be mutually supportive and have conformity with one another so that the results of this study can be justified scientifically. The conclusion of this study, namely; (1) business contracts are usually carried out by SMEs in general do not engage the services of a notary. Form of the contract was generally not made in the format of a standard contract. In general, SMEs also do not use technology information in their business transactions. Only a small portion of SMEs that have used the services of a notary and technology information in conducting business transactions, (2) while the main obstacles SMEs have not been optimally use the services of a notary in the transaction business was due to cost factors (notary) who felt still quite burdensome, attributed to the relatively small volume of the SMEs business.   • Legal Protection of Donation-based Crowdfunding Zakat on Financial Technology: Digitalization of Zakat under Perspective of Positive Law and Islamic Law

    Abstract:

    The aim of this research is to see the Legal Protection of Donation-based Crowdfunding zakat on financial technology due to the huge spreading of startup with zakat fund in Indonesia. Meanwhile there is still no specific regulation protecting various risks that will arise especially the risk of unobvious identity, potential disputes, dissimilarity of the zakat purpose and the implementation of zakat distribution, and the other deviations. This type of research is library Legal research with conceptual and state approach. The result of the research shows that in positive law there is no Legal Protection regulation in Zakat based on Donationbased Crowdfunding. The regulation only crowdfunding contains investment element andgenerate profit as described in Act Number 21 Year 2011 regarding Financial Services Authority. While Zakat-based Donation-based Crowdfunding is a nonprofit-oriented type of product. This makes the absence in the elements of justice and Legal certainty. The regulation on zakat only described in Law number 23 year 2011 which is not contained that system. In the Protection of Islamic law, the certainty of the implementation of the contract is stipulated in the zakat based on sharia agreement that must comply with the various principles and provisions of sharia, whether the arrangement starts from the intention, the process of agreement, transparency, and all aspects relating to Amil, Muzakki and Mustahiq zakat (Who is the mustahiq and what kind and how the implementation). finally, the researcher hopes that this research will bring inputs for government to make more comprehensive regulations on zakat in its digital form.

MTCP, 12 Page. Abstract: This study describes or illustrates well as address issues of Legal Protection of children as witnesses and/or of human trafficking in the investigation process. Legal Protection is a Protection given to the subject of the law in the form of Legal instruments both preventive and repressive, both written and unwritten. Problems studied are (1) Urgency Legal Protection of children as victims of trafficking crimes in the investigation process, (2) The Legal Protection of children as victims of human trafficking in the investigation. The research method used is empirical jurisdiction. Some indicators of Legal Protection of children as witnesses of human trafficking victims, namely: the role of victims, Position witnesses and victims, non-technical, and technical. Technical indicators include several things, namely: The rooms that used to investigated witness and victims, investigated procedures. Whereas, non-technical indicators include: policy and paradigm of police itself which says that Legal Protection should be given to children because of the laws governing the Protection of children as victims and as perpetrators.
