Challenges of operationalising good industry practice and best environmental practice in deep seabed Mining Regulation

GroganAbstract:Abstract Advances and innovation in deep-water technologies have fuelled a rapid and increased interest in the commercial exploitation of deep seabed minerals. Notwithstanding the apparent momentum in this sector, numerous regulatory, technical and environmental challenges remain. The latter, in particular, solicits on-going concern amongst various stakeholders due to the potential impact of mineral exploitation on the deep-sea environment. The organisation tasked with the management and control of mineral-related activities in international waters, the ‘International Seabed Authority' (ISA), is mandated to develop ‘the Mining code’, a body of international rules, Regulations and procedures that will regulate prospecting, exploration and exploitation in areas beyond national jurisdiction. Accordingly, the aim of this article is to provide a critical assessment of two commonly invoked, yet often ambiguous, concepts in this regulatory discourse – that being ‘Best Environmental Practice’ and ‘Good Industry Practice’. The paper draws on a comparative evaluation of these concepts in established international guidance standards, in order to highlight certain considerations for the practical implementation thereof for the deep seabed Mining industry. In doing so, the research provides policy and theoretical contributions to the field of natural resources Regulation. It further enhances the understanding of a critical component to the sustainable operationalisation of the industry, whilst acknowledging the unique environmental protection requirements associated with the deep seabed environment.

GIS-Based Subsidence Prediction of Yuzhou Goaf Area at the Middle Route of the South-to-North Water Diversion Project
Geotechnical and Geological Engineering, 2018Co-Authors: Renwei Ding, Handong Liu, Jinyu DongAbstract:The phase I main canal of the Middle Route of the South-to-North Water Diversion Project crosses the coal Mining area in Yuzhou city, and thus it is very important to predict the surface subsidence of the goaf. The GIS-based prediction system for Yuzhou goaf area subsidence has been developed by data collection, and the subsidence, horizontal movement, tilt and curvature are predicted for five mined out areas. The results show that the surface movement and deformation in the strike and dip directions are not more than the stability indexes specified in the coal Mining Regulation under buildings, water-bodies and railways, indicating that the residual deformation will not cause damage against the canal. The forecasting and monitoring values of Guo coal mine goaf and original Xinfeng goaf, located in Liang Town, Yuzhou City, are relatively large, thus the canal in this region may be affected and the safety monitoring should focus on this region.

deriving social benefits from Mining through Regulation lessons learned in south africa
The Extractive Industries and Society, 2019Co-Authors: Caitlin C CorriganAbstract:Abstract Shortly after the transition to the post-apartheid state, South Africa began a process of requiring Mining companies to invest in community and workforce development in areas surrounding operations. This development shifted the concept of corporate social responsibility from mainly a discretionary activity to an issue of regulatory compliance. Drawing on field-based interviews and regulatory and company documents, this article analyzes the process of compliance with South Africa’s Mining Regulation and the stakeholders formally involved or marginalized in this process. Findings demonstrate the challenges that remain in ensuring that Regulation leads to Mining company activities that actually yield effective and impactful local social benefits. While Regulation has increased entry points for government involvement and has increased corporate social spending, it has undermined the idea of corporate citizenship by focusing on mandatory compliance, while failing to put in place effective process transparency and monitoring mechanisms that would allow for local government and community participation and sanctioning. The lessons learned in the case of South Africa have implications as more African countries attempt to regulate the promotion of social benefits derived from Mining.

Challenges of corporate social responsibility (CSR) in domestic settings: An exploration of Mining Regulation vis-à-vis CSR in Ghana
Resources Policy, 2016Co-Authors: Nathan AndrewsAbstract:Abstract While some attempts have been made by countries such as Indonesia to make corporate social responsibility (CSR) mandatory, the whole idea everywhere else is benched on the voluntariness and discretion of corporations to pick and choose what would constitute their social responsibility initiatives. But the argument is that for countries with weaker Regulation, corporations may not do much in terms of real CSR activities that transcend mere window dressing. This paper examines the domestic institutional dynamics that influence CSR policies and practices in Ghana. It attempts to emphasize the argument that effective domestic Regulation and governance can play a role in ensuring sustainable corporate practices and initiatives, leading to a positive impact on the lives of people living in local Mining communities. Insight for the paper is drawn from interviews conducted with several stakeholders in Ghana’s Mining sector, including government officials and officers of two foreign-owned Mining companies (i.e. Newmont Ghana Gold Ltd. and Chirano Gold Mines Ltd.).
