    Abstract:

    The cultural and societal diversity in the jurisprudence of living dangerously reflects equally diverse views on the deeper question of law’s Moral purpose. What duty of care does (or does not) a Community owe to those at the greatest risk of harm to their homes and persons? And is there also a right to be left alone — to assume all the risks and all the responsibilities for one’s own well-being, neither helped nor hindered by the Community of which one is a part? This article reports comparative research being done on two states in the U.S. that have used the law to answer these Morally freighted questions in very different ways, with specific regard to land use regulation in forested areas where wildfires have taken many lives and destroyed billions of dollars in residential property. It also suggests how this same analytic framework might be applied to transnational research in other legal cultures also endangered by catastrophic wildfires, such as Australia and Spain. La diversidad cultural y social en la jurisprudencia de los lugares en los que se vive bajo un peligro refleja equitativamente diferentes opiniones sobre el proposito Moral de la ley, un tema mas profundo. ?Que obligacion tiene (o no) una comunidad de ofrecer atencion a aquellos individuos en mayor riesgo de sufrir danos sobre sus hogares o personas? ?Y existe tambien el derecho a que cada uno asuma todos los riesgos y todas las responsabilidades sobre su propio bienestar, sin que le ayude, o le moleste, la comunidad de la que forma parte? Este articulo presenta una investigacion comparativa desarrollada en dos estados de EE.UU. que han utilizado la ley de manera muy diferente, para responder a estas preguntas de gran carga Moral, con especial referencia a la regulacion del uso de la tierra en zonas donde los incendios forestales han causado muchas victimas personales ademas de perdidas de millones de dolares en propiedades residenciales. Tambien sugiere que este mismo marco analitico podria aplicarse a la investigacion transnacional en otras culturas juridicas tambien amenazadas por los incendios, como Australia y Espana.

    Introduction In June 2009, the House of Delegates (HOD) of the American Physical Therapy Association (APTA) passed a major revision of the APTA Code of Ethics for physical therapists and the Standards of Ethical Conduct for the Physical Therapist Assistant . The revised documents will be effective July 1, 2010. Purpose The purposes of this article are: (1) to provide a historical, professional, and theoretical context for this important revision; (2) to describe the 4-year revision process; (3) to examine major features of the documents; and (4) to discuss the significance of the revisions from the perspective of the maturation of physical therapy as a doctoring profession. Process of Revision The process for revision is delineated within the context of history and the Bylaws of APTA. Format, Structure, and Content of Revised Core Ethics Documents The revised documents represent a significant change in format, level of detail, and scope of application. Previous APTA Codes of Ethics and Standards of Ethical Conduct for the Physical Therapist Assistant have delineated very broad general principles, with specific obligations spelled out in the Ethics and Judicial Committee's Guide for Professional Conduct and Guide for Conduct of the Physical Therapist Assistant. In contrast to the current documents, the revised documents address all 5 roles of the physical therapist, delineate ethical obligations in organizational and business contexts, and align with the tenets of Vision 2020. Significance The significance of this revision is discussed within historical parameters, the implications for physical therapists and physical therapist assistants, the maturation of the profession, societal accountability and Moral Community, potential regulatory implications, and the inclusive and deliberative process of Moral dialogue by which changes were developed, revised, and approved.

    Abstract:

    PURPOSE/OBJECTIVES: To explore ethical conflicts in oncology practice and the nature of healthcare contexts in which ethical conflicts can be averted or mitigated. RESEARCH APPROACH: Ethnography. SETTING: Medical centers and Community hospitals with inpatient and outpatient oncology units in southern California and Minnesota. PARTICIPANTS: 30 oncology nurses, 6 ethicists, 4 nurse administrators, and 2 oncologists. METHODOLOGIC APPROACH: 30 nurses participated in six focus groups that were conducted using a semistructured interview guide. Twelve key informants were individually interviewed. Coding, sorting, and constant comparison were used to reveal themes. FINDINGS: Most ethical conflicts pertained to complex end-of-life situations. Three factors were associated with ethical conflicts: delaying or avoiding difficult conversations, feeling torn between competing obligations, and the silencing of different Moral perspectives. Moral communities were characterized by respectful team relationships, timely communication, ethics-minded leadership, readily available ethics resources, and provider awareness and willingness to use ethics resources. CONCLUSIONS: Moral disagreements are expected to occur in complex clinical practice. However, when they progress to ethical conflicts, care becomes more complicated and often places seriously ill patients at the epicenter. INTERPRETATION: Practice environments as Moral communities could foster comfortable dialogue about Moral differences and prevent or mitigate ethical conflicts and the Moral distress that frequently follows.

    English Abstract: Apologising is part of civil society and vitally important for maintaining social fabric. Many jurisdictions in Australia, Canada, the USA and UK have enacted apology-protecting legislation in the hope that the process of apologising might reduce civil litigation, particularly litigation about medical negligence. The apology is also significant in restorative justice and may operate in mediation or as a remedy. This article focuses on how the social and psychological process of apologising and being apologised to is affected by the Moral communities within which the apology takes place. It argues that the failure to take this process seriously may impact adversely on the achievement of the aims of restorative justice and the apology protecting laws. Spanish Abstract: Las disculpas forman parte de la sociedad civil y son de una importancia vital para mantener el tejido social. Muchas jurisdicciones de Australia, Canada, EEUU y el Reino Unido han promulgado legislaciones de proteccion de las disculpas, con la esperanza de que el proceso de disculpa reduzca el numero de litigios civiles, sobre todo litigios motivados por negligencias medicas. La disculpa es significativa, ademas, en la justicia restaurativa, y podria tener efecto en una mediacion o como remedio. Este articulo se centra en la forma en que el proceso social y psicologico de pedir y de recibir disculpas queda afectado por las comunidades Morales en las cuales se produce la disculpa; no tomar en serio este proceso podria tener consecuencias adversas en la consecucion de los objetivos de la justicia restaurativa y de las leyes que protegen la disculpa.
