    Rights of property are the main prerequisites for the existence of any Political society, as it is an objective necessity for their normal functioning and continuity. Property and right of property are the constituent of autonomous life in the realization of the world of individual or collective goals, without the protection and guarantee of which, it is oft en stated that the respect and enjoyment of the entirety of other constitutional rights cannot be imagined. Rights of property are presented and considered as one of the most important issues of legal and Political Doctrines, and it represents one of the fundamental issues of national and international policy. The classic liberal property concept has dominated the modern legal and Political debates and imagination. The property institution is oft en conceived as a quasi absolute subjective right, a concept that, in the modern era, competes with alternative concepts that have influenced both state policies and modern legal culture and consciousness, the consequences of which are reflected in legal systems. One of the most influential alternative concepts is the social function of property,1 of course in modern legal culture the property is understood as an individual right, limited not only by the rights of others, but also by the public interest. Thus, modern legal thinking, although it regards it as a basic element of the normal functioning of the Rule of Law, the private property institution has given a new emphasis to this right, altering the basis for the attribution of property power by the fact that, the relation of the individual to his/ her personality in a social organization, is considered as substantive to the juridical order, therefore the volume of ownership power may not be more unconditional. The social function cannot be identified with the external limitation of ownership which is reserved to collectivity, but it is presented as an elitist, unifying expression of the assumptions of legal qualification, so as to identify the content of the considered situation.2 In the doctrine it is oft en argued that private property is indispensable for the ethical development of the individual or for the creation of a social environment in which people can progress as free and responsible agents, but that the property is no longer considered a myth, which was considered inviolable, as was the case with Article 29 of the Albertin Statute.3 It is enough to bear in mind the Aristotelian argument, which stated that property promotes virtues as prudence and responsibility, or Plato in his work "Republic" when he argues that collective ownership is necessary to promote the importance of recognizing common interest, also to avoid social "disruption". According to the theory of natural law, with the main representatives of the 17th and 18th centuries John Locke and Thomas Jefferson, people by nature are free and equal and possess inalienable and intangible rights, which state power can only protect, but not restrict or cancel them, as the individual's rights and freedoms in essence constitute justice as a value. This was also the attitude of the founders of the nations of Western democracies inspired by the principles and innovative ideas elaborated by representatives of the illuministic theories in Europe, which thought that the protection of private property was conceived as a mission and one of the essential tasks of the state. Ownership is one of the constitutional rights that has undergone a significant transformation compared to its original configuration. First legal-constitutional acts 4 of the XVIII century, inspired by modern naturalius, 5 proclaimed the sacred and intangible character of the property, so the concept of private property was presented as being born before the state, and the latter had the duty to recognize and guarantee it. With the overthrow of philosophical theories influenced by natural ius, private property continued to resist and be at the center of philosophical doctrine as well as legal-constitutional provisions,6 even advanced until it was considered an absolute subjective right, which was identified with the notion of liberty itself

    By the middle of the second decade of the twenty-first century, extremist groups, operating in different countries and at the global level, have considerably extended their informational, tactical, strategic, ideological, Political network, as well as resources and economic interaction, the process and the results of which have become especially obvious in the European Union and the Eurasian Customs Union member states. All sorts of terrorist and religious groups have mastered the skills of exploiting territorial conflicts across the post-Soviet space and the efforts in finding solutions to get out of the ethnic and confessional crisis. Radical Islam is ready and able to compete with the “classical” conservatism (paleoconservatism) and “new right” in turning to traditionalism, moralism and religious fundamentalism. It is not inferior to socialism in its egalitarianism and anti-bourgeois social and economic propaganda, and also to fascism (National Socialism) in totalitarianism and the willingness to sow destruction and death.1 Islam has already become the “new alternative style” with a vast collection of discursive practices among the highly varied social groups not only in Muslim countries but in the Customs Union (CU) and the EU member states. Islam is gradually developing into a global radical anti-systemic ideology, filling the niche previously occupied by socialist ideology now in an ideological crisis. The Communist system was liquidated, the Communist ideology and the leftradical groups lost part of their appeal. The void was filled with religiously tinged Political Doctrines to let people express their dissatisfaction with the capitalist system. This added special importance to theoretical studies of a complex set of problems, related to the specifics of radical Islam, as we know it today. It is equally important to consider its pronounced impacts on the main components of the social and Political systems of the EU and the CU and the possibilities to forecast, with a great deal of reliability, the trends in the direction of influence of Islamism, with due account for the forms of manifestation of radicalism at different levels of discursive practices. These problems should be addressed and resolved before proceeding to the task of ensuring efficient Political governance and choosing the optimal trends of opposing these negative social and Political phenomena. Studying the nature, types and forms of manifestations of radical Islam in the EU and CU is instrumental for inter-state structures and special services in preventing ethnic and social deviations. © 2017, CA and CC Press AB.     Abstract Islamism is a complex phenomenon with multiple dimensions and various ramifications. Like other Political Doctrines, Islamism, in its contemporary shape, is an ‘ideology’, a ‘movement‐organisation’ and a ‘form of government’. This study is predominantly devoted to the analysis of Islamism as a totalitarian ideology. We are interested in knowing how and when this concept has been fabricated; how it has evolved and what differentiates it from ‘Islam’. Aiming at a conceptual clarification, we propose a definition of Islamism which enables us to grasp the essence of this phenomenon in its variations (Sunni, Shi'a and Wahhabi) and its different shapes (global and national). Our analysis shows that, despite sectarian and other differences between various Islamist groups, their final objective remains the same. They all aim at the re‐instauration of the Islamic might in the world: to achieve this goal, the use of violence is not rejected.

    Disertacija se bavi pitanjem ljudskih prava radnih migranta u Europskoj uniji na teorijskoj i empirijskoj razini. Na razini suvremene normativne političke teorije rad istraţuje odnos imigranata i zajednice primateljice kroz suprotstavljenost kozmopolitizma i komunitarizma te utvrĎuje jesu li ove političke doktrine potencijalno pomirljive u pristupu ljudskim pravima imigranata bilo na razini njihovog ulaska ili članstva u zajednicama primateljicama. U svom empirijskom dijelu disertacija rasvjetljuje kako se dihotomija kozmopolitizam-komunitarizam odraţava na europsku imigracijsku politiku te moţe li se kroz analizu njezinog dizajna doći do zaključka o mogućnosti pomirenja spomenutih teorijskih pristupa. U tu svrhu metodom tematske analize ispituju se ciljevi i instrumenti, kao i ciljane skupine te načela oblikovanja ove politike u ključnim dokumentima Europskoga vijeća, Europske komisije, Vijeća ministara i Europskog parlamenta. Rad predlaţe modele dizajna europske imigracijske politike i povezuje ih s navedenim teorijskim pristupima u donošenju zaključka o elementima u kojima su oni pomirljivi u pristupu ljudskim pravima radnih migranata.The dissertation deals with human rights of labour immigrants in the European Union at the theoretical and the empirical level. At the level of contemporary normative Political theory, the dissertation explores the relationship between immigrants and receiving communities through contraposition of cosmopolitanism and communitarianism and establishes whether these Political Doctrines can be reconciled in their approach to immigrants‘ human rights either at the level of their admission or membership. In its empirical part, the dissertation throws light on how the dichotomy between cosmopolitanism and communitarianism is reflected in the EU immigration policy and discusses whether the conclusion about their rapprochement may be reached by analysing its design. For that purpose, the methodology of thematic analysis is used in order to examine the objectives and instruments, as well as the target groups and policy principles in the key documents of the European Council, the European Commission, the Council of Ministers and the European Parliament. The dissertation proposes models of EU immigration policy design and connects them to the two theoretical approaches in reaching the conclusion about the elements in which they may be reconciled
