La sodomía en Chile (1875-1928) : una perspectiva desde la criminalidad y la ciencia /

La novedad de la investigación radica en el análisis por un lado de las fuentes ligadas a la medicina y el derecho penal y de las provenientes de los procesos criminales de sodomía. La primera parte de la investigación se estudia una historia del delito-pecado de sodomía por medio de las legislaciones, los tratados y comentarios del derecho penal chileno y las discusiones para la redacción del Código Penal de 1874. En Chile entre 1541 hasta 1875 se utilizó la legislación de la monarquía española que sancionaban la sodomía. Posteriormente, después de la entrada en vigencia del Código Penal de 1874 el delito de sodomía siguió vigente hasta el año 1999. La segunda parte de esta investigación analiza los saberes que emplearon los médicos y los abogados chilenos para patologizar y condenar las prácticas sexuales entre varones, desde los diversos enfoques de las ciencias de la vida que circularon en el mundo académico y la opinión pública de la época analizada: la medicina legal francesa, la teoría de la degeneración, la criminología italiana, la criminología de Lyon y la psicopatología.Estos enfoques médicos no sólo fueron utilizados en el ámbito médico sino que también en el derecho penal para explicar "científicamente" el artículo 365 del código penal chileno que condenaba a los acusados por el delito de sodomía a tres años de prisión. Analizamos la recepción de la medicina legal francesa a través del compendio de medicina legal publicado por el médico chileno Federico Puga Borne que patologiza la sodomía siguiendo los criterios de Ambroise Tardieu. La teoría de la degeneración que señala en sus postulados sobre "los degenerados" y "taras hereditarias", en los escritos de los abogados Tomás Ramírez, Enrique Broghamer y de un escritor anónimo. Se estudiará la recepción del concepto homosexual con el primer escrito chileno del tesista Salvador Nechochea. En la tercera parte de esta investigación se estudio el delito de sodomía en Chile 1875 a 1928 desde la perspectiva de los noventa y tres procesos criminales pesquisados que corresponden a los expedientes judiciales que fueron extraídos del Archivo Nacional Histórico con sede en Santiago de Chile de las cajas y legajos correspondientes a los catorce fondos judiciales del crimen.En esta parte de la tesis se analizaron las diferentes prácticas sexuales de la sodomía pasando por la sodomía consensuada, la violación entre adultos y la violación a menores. Se estudio la importancia y el rol de los diferentes enfoques médicos y su real aplicación en los procesos criminales seleccionados. Asimismo se describió los roles de los diferentes actores involucrados en los procesos criminales: acusados, acusadores, padres de los niños, jueces, policías, testigos, procuradores, promotores fiscales y médicos informantes.This PhD dissertation studies the sexual practices between males, specially the Sodomy crime in Chile from 1875 to 1928. Later, after coming into force the Criminal Code from 1874, the crime of Sodomy was still valid until 1999. The second part of this research analyses the knowledge's, used by Chilean doctors and lawyers, to condemn the sexual practices between males from different approaches in life sciences, circulating in the academic world and popular opinion from the époque: the French Legal Medicine, the theory of degeneration, the Italian criminology, the criminology from Lyon, and the psychopathology. These medical approaches were not only used in the medical area, but also in the criminal law to explain "scientifically" the article 365 of the Chilean Law Code, which condemned the defendants during three years in jail. I analyze how French Legal Medicine was received through the Legal Medicine compendium, published by the Chilean doctor Federico Puga Borne, who pathologizes Sodomy according to the criteria of Ambroise Tardieu. The theory of degeneration points out the "depraved" and "hereditary imperfections" in the writings of the lawyers Tomás Ramírez, Enrique Broghamer and an anonymous writer. In this research, it is studied the concept of "homosexuality" through the first Chilean writing of the thesis student Salvador Nechochea. In the third part of the research, it is studied the crime of Sodomy in Chile from 1875 to 1928, throughout ninety-three criminal procedures, corresponding to judicial records, found in fondos judiciales del crimen from the Archivo Nacional Histórico, based in Santiago de Chile. In this part, it is analysed different sexual practices of the Sodomy, including agreed Sodomy, rape between adults and violation to minors. It was studied the importance and role of different medical approaches, as well as their application in the criminal procedures selected. the harmless psychopath legal debates promoting the decriminalization of Sodomy in the united states
2015Co-Authors: Marieamelie GeorgeAbstract:Sexual psychopath statutes, under which courts committed individuals charged with or convicted of certain crimes, typically sex offenses, to psychiatric institutions, proliferated in the United States between the late 1930s and early 1960s. Twenty-nine states and the District of Columbia enacted versions of these statutes in response to a sex-crime panic that swept the nation after a wave of publicity about violent sex crimes committed against children. While the statutes varied widely in terms of the crimes that triggered the laws’ application and in their definitions of sexual psychopathy, they were almost always applied to men convicted of consensual Sodomy and were used to commit homosexual men to institutions. However, in 1955 -- only four years after the rush to enact sexual psychopath laws ended -- the American Law Institute (ALI) voted to exclude consensual Sodomy from its Model Penal Code (MPC), indicating that consensual Sodomy was not a criminal matter. Therefore, in a very short period, a group of influential legal thinkers had moved consensual homosexual activity from a sign of possible pathology to a legally benign, albeit still immoral, practice. The MPC, a model criminal statute aimed at stimulating penal law reform throughout the United States, became highly influential in legislative efforts to revise state criminal codes, leading twenty-two states to repeal their Sodomy statutes by 1978. This article explains how American law evolved from the widespread implementation of sexual psychopath statutes to the decriminalization of Sodomy, arguing that this shift emerged out of debates around sexual psychopath laws and Alfred Kinsey’s reports on male and female sexual behavior, which questioned many of the assumptions underlying both sexual psychopath statutes and criminal code provisions on consensual Sodomy. State commissions evaluating sexual psychopath laws relied on Kinsey’s data to argue that the statutory schemes were not based on scientific evidence and therefore needed to be amended or repealed. The majority of their reports commented on the inappropriateness of including consensual Sodomy under the umbrella of psychopathy, thereby separating homosexuality not just from pedophilia but also from violence. Several commissions also questioned whether consensual Sodomy should be criminalized at all. The sexual psychopath commission reports influenced the ALI’s decision to decriminalize Sodomy, presaging and contributing to a significant change in American criminal law, as members of the MPC committee drew upon the commission debates in their arguments for the decriminalization of consensual Sodomy. The state commission reports, by providing a forum for politicians and lawyers to develop and express a reformist viewpoint, created a discourse in favor of changing criminal laws on consensual Sodomy. This thus article identifies the missing link between a legal regime that characterized homosexuality as psychopathy and one that adjudicated consensual homosexual Sodomy as noncriminal conduct.

Journal of the History of Sexuality, 2015Co-Authors: Marieamelie GeorgeAbstract:I n S e p t e m b e r 1940 p o l I c e arrested and charged thirty-five-year-old Bert Chapman with committing an “act of gross indecency” with John Bates, a consenting adult, at his home in Livingston County, Michigan. Before his trial, the prosecuting attorney filed a petition seeking to have Chapman certified as a criminal sexual psychopath and committed indefinitely to a psychiatric hospital. As required by the statute, the court appointed two psychiatrists, who examined Chapman and diagnosed him with “psychosexual deviation, homosexual (sexual psychopath).” The doctors warned that Chapman “must be considered a distinct sexual menace and a source of serious concern in a free community” not only because of his “homosexual practices” but also because “his psychosexual deviation is very likely to assume a much more ominous manifestation, that of pedophila [sic] (the use of children as sexual objects).” Despite their acknowledgment that Chapman had never exhibited any sexual interest in children, the psychiatrists found that the “possibility [of pedophilia] must be gravely considered.” After a brief hearing, the court accepted the psychiatrists’ findings and ruled that Chapman was a “criminal sexual psychopathic person.” The court ordered him confined to a psychiatric institution until he “shall have fully and permanently recovered from [his] psychopathy.” In committing a man to a psychiatric hospital, possibly for the rest of his life, for engaging in a consensual, entirely private sexual act, the People

Meanwhile, Indonesian children experience 183 cases of rape and sexual abuse, 54 cases of Sodomy or pedophilia – children as a perpetrator, 42 cases of Sodomy or pedophilia – children as a victim, and 44 cases of abortion. A preliminary study on March 2020 in West Surabaya showed that 6 in 10 children aged 3-5 years faced sexual abuse or harassment and rape by their closest circle. The research aims are to describe the level of knowledge, perception, role implementation, emotional connection between father and child in the accompaniment of psychosexual development of children. This paper combined quantitative and qualitative methodologies with a phenomenological approach. Respondents were father compatible with inclusion criteria was determined by researchers. This study used a total sampling of 112 fathers who lived in West Surabaya. The research instruments were a questionnaire and observation sheet. Data analysis utilized percentage analysis, data reduction, and data triangulation. There were 64.5% low levels of knowledge, 70.5% negative perceptions, 63.4% fathers absence in assisting the psychosexual development of children, and 69.6% absence of emotional connection. The new normal period gave limited the role of a father in children's psychosexual development.

Meanwhile, Indonesian children experience 183 cases of rape and sexual abuse, 54 cases of Sodomy or pedophilia – children as a perpetrator, 42 cases of Sodomy or pedophilia – children as a victim, and 44 cases of abortion. Preliminary study on March 2020 in West Surabaya showed that 6 in 10 children aged 3-5 years faced sexual abuse or harassment and rape by their closest circle. The research aims are to describe the level of knowledge, perception, role implementation, emotional connection between father and child in the accompaniment of psychosexual development of children. This paper combined quantitative and qualitative methodologies with a phenomenological approach. Respondents were father compatible with inclusion criteria – was determined by researchers. This study used total sampling – 112 fathers lived in West Surabaya. The research instruments were questionnaire and observation sheet. Data analysis utilized percentage analysis, data reduction, and data triangulation. Result: There were 64.5% low level of knowledge, 70.5% negative perception, 63.4% father absence in assisting psychosexual development of children, and 69.6% absence of emotional connection. Conclusion: The father’s role in assisting the psychosexual development of children aged 3-5 years can decrease the number of psychosexual disorders in adulthood
