    "Le présent rapport a pour objet de fournir un commentaire détaillé sur la faisabilité globale d'un portail unique de dépôt électronique hébergé par le secteur privé (modèle Transactionnel central de dépôt électronique) fondé sur la norme LegalXML. Le résultat attendu principal est une opinion concernant la faisabilité du modèle à guichet unique (portail électronique). D'autres résultats attendus comprennent : une connaissance accrue chez les intéressés du modèle de fournisseur de services et une évaluation préliminaire de l'appui que le modèle reçoit. Nous avons utilisé deux véhicules d'analyse principaux pour réaliser les objectifs de l'étude susmentionnés : des analyses documentaires et des entretiens auprès d'intéressés. Les analyses visent explicitement à : examiner des approches différentes au dépôt électronique, notamment un système de dépôt électronique comme extension de chaque instance, et l'hébergement par le secteur privé par opposition au secteur public d'un guichet unique; recenser les questions et les facteurs de risque critiques se rapportant à la mise en place de services de dépôt électronique dans les cours, notamment la protection des renseignements personnels, la propriété intellectuelle et la sécurité, et en discuter; opposer chacun de ces points au modèle de FSA; faire des recommandations sur la stratégie permettant de régler les questions et les facteurs de risque critiques. L'étude a révélé que : de nombreux intéressés appuient le dépôt électronique; de nombreux intéressés (p. ex. les avocats) ne font aucune distinction entre les formes différentes de dépôt électronique, tandis que d'autres s'en soucient beaucoup (p. ex. administrateurs de certaines cours); un modèle de fournisseur de services de dépôt électronique (FSDE) à guichet unique offre quelques avantages importants par rapport à une approche de dépôt électronique individuelle, surtout pour ce qui concerne les coûts et la plate-forme de l'avenir; un modèle de FSDE du secteur privé offre des avantages considérables par rapport à un modèle de FSDE du secteur privé, surtout en matière de succès et de coût de la mise en œuvre.""The purpose of this report is to provide a detailed commentary on the overall feasibility of a single window private sector hosted Court E-filing portal (Transaction Hub E-file model) based on the LegalXML Standard. The primary deliverable is an opinion concerning the feasibility of the single window model (e-Hub). Other deliverables include: a heightened awareness among stakeholders of the Service Provider Model, and a preliminary assessment of support for the model. In order to achieve the objectives of the study as outlined above, two primary vehicles for analysis were utilized: literature reviews and stakeholder interviews. The analyses sought specifically to : Review alternate approaches to e-filing including e-filing system as an extension of each court, and private versus public sector hosting of a single window approach; Identify and discuss the critical issues and risk factors relating to the introduction of electronic filing services in the Courts, including privacy, copyright, and security; Examined each of these issues against the ASP model; Made recommendations regarding strategies for addressing critical issues and risk factors. The study found that: There is support among a broad constituency of stakeholders for e-filing; Many stakeholders (e.g. practitioners) do not differentiate among different forms of e-filing, while others care a great deal (e.g. individual court administrations); A single window electronic filing service provider (EFSP) model has some significant benefits over the individual e-filing approach, primarily in the areas of cost and platform for the future; A private EFSP model has significant benefits over a public sector EFSP, primarily in the areas implementation success and cost.

  • Factors Affecting Social Devolution of Bandar Lengeh (1897-1949)

    Abstract:

    Historically, Bandar Lengeh has been the main seaport of Larestanand the Transaction Hub of the import and export of goods in the Persian Gulf since 1834. The port maintained its authoritative position until 1897, but from then onward,the social and business dynamism of Bandar Lengehdevolved. Studies done on the issue emphasize on the economic factors in the  social devolution of Bandar Lengeh but it seems that factors affecting the social devolution of Bandar Lengeh were not merely economic, but rather equally political and ideological in turn. The current descriptive-analytic study analyses the two other factors, i.e., political and ideological structure of Bandar Lengeh, besides its economic structure,via application of Louis Althusser’s over-determination theory. The tested hypothesis is: “Structural contradictions (political, economic, and social contradictions) led to the social devolution of Bandar Lengeh”. In fact, since 1899, political, economic, and social contradictions had invaded Bandar Lengeh. New customs duties or tariffs of 1899, imprudence ofnone-native and governmental officials of customs, social and political insecurity in the coasts of Lengeh after the Constitutional Revolution, the monopoly law for government business, the compulsory military service law, the command of “mandatory unveiling”, and the ways of escape from these contradictions (human and capital migration, smuggling, and bribery) all led to the social devolution of Bandar Lengeh
