Journal of North University of China, 2012Co-Authors: Zhuang QianlongAbstract:An accurate definition of Undercover Investigation can not only help clear the nature of its behavior,but also help demarcate its border.Meanwhile,the purpose of litigation(punishing the crimes and guaranteeing the human rights) can be achieved.Both the Common Law and Civil Law countries definite Undercover Investigation based on the classification of generalized sense and narrow sense.Many scholars in China insist that we should adopt the narrow sense concept.But for the discrepancy which is stressed in the concept,there exists different Undercover Investigation concept,such as "the degree to conceal factors","time factors","submerging factors" and "trial evidence factors".Through comparative research among foreign countries' concept of Undercover Investigation,this paper adopts purpose analysis method to analyze and compare our country's traditional concept.However,the traditional concept absorbs too many form element of Undercover Investigation,and omits many substantive elements which reflect the content of the Undercover Investigation,such as the deception element,nature element,and specification's purpose element.In order to regulate its purpose,the concept of Undercover Investigation should include the following elements as the reasons why start this Investigation,the Investigation attributes,and the purpose of regulation.

Two questions constitute the core of this work: Is there research that from the beginning, development and/or products, always complies with informed consent? And, if the unfinished nature of informed consent is a state of affairs and a research option, when do we make clear that a research is partially or totally Undercover? Who does it? What for? In this case, the methodologies and their specific practices need to make visible and problematize, through the call to their transformation, the fields of ideologically configured social relations that constitute them. A partir de dos estudios de caso correspondientes a dos investigaciones en el campo de la salud sexual, la ciudadanía sexual y los derechos humanos que apelan, de distinta forma, a técnicas de investigación encubierta, se discuten algunos alcances y limitaciones de las aproximaciones metodológicas no basadas en el consentimiento informado. Dos preguntas constituyen el ejecentral del artículo: ¿existen investigaciones que, en su inicio, desarrollo y/o productos, cumplan siempre con el consentimiento informado? Y, si el carácter inacabado del consentimiento informado es un estado de las cosas y una opción investigativa, ¿cuándo se visibiliza o no que una investigación tiene un carácter parcial o totalmente encubierto? ¿Quién lo hace? ¿Y para qué?
