    Abstract:

    This book focuses on the rules-based multilateral trading system established by the World Trade Organization, with particular emphasis given to the rich and detailed jurisprudence developed by the WTO's Appellate Body. After introductory chapters on international Economics, international law, and US and EU constitutional and institutional issues relating to international trade regulation, the book explores the WTO's structure and takes a detailed look at its dispute settlement system. The heart of the book then treats the basic GATT rules on (i) trade liberalization (tariffs and quotas), (ii) non-discrimination (MFN and national treatment and the exceptions for FTAs, health and conservation), (iii) standards and (iv) trade remedies (safeguards, dumping and subsidies).     Abstract:

    Since the first edition of The World Trading System was published in 1989, the Uruguay Round of trade negotiations has been completed, and most governments have ratified and are in the process of implementing the General Agreement on Tariffs and Trade (GATT). In the Uruguay Round, more than 120 nations negotiated for over eight years, to produce a document of some 26,000 pages. This new edition of The World Trading System takes account of these and other developments. Like the first edition, however, its treatment of topical issues is grounded in the fundamental legal, constitutional, institutional, and political realities that mold trade policy. Thus the book continues to serve as an introduction to the study of trade law and policy. Two basic premises of The World Trading System are that Economic concerns are central to foreign affairs, and that national economies are growing more interdependent. The author presents the Economic principles of international trade policy and then examines how they operate under real- world constraints. In particular, he examines the extremely elaborate system of rules that governs international Economic Relations. Until now, the bulk of international trade policy has addressed trade in goods; issues inadequately addressed by policy include trade in services, intellectual property rights, certain investment measures, and agriculture. The author highlights the tension between legal rules, designed to create predictability and stability, and the governments need to make exceptions to solve short-term problems. He also looks at weaknesses of international trade policy, especially as it applies to developing countries and economies in transition. He concludes with a look at issues that will shape international trade policy well into the twenty-first century.

    V souvislosti s postupným uvolňováním kubánského komunistického režimu dochází k postupnému rušení bariér a blokád, jež v minulosti některé země uvalily na Kubánskou republiku. Díky rušení těchto bariér dochází k otevírání nového trhu, jenž byl v minulosti jedním z velkých prostorů pro mezinárodní obchod ČSSR. Cílem této práce je analýza statistik zahraničního obchodu mezi ČSSR a Kubou v 70. letech 20. století, zvláště pak po přistoupení Kubánské republiky do RVHP. Konkrétně jsou v práci zkoumány jednotlivé komodity, jež patřili k nejvýznamnějšímu obchodovanému zboží v daném období. Metodou zkoumání je analýza importu a exportu mezi Československem a Kubou a porovnání těchto statistik se souhrnnými statistikami československého zahraničního obchodu.     Abstract:

    Abstract Can Economic interdependence reduce conflicts among states in East Asia? The so-called ‘cold politics and hot Economics’ has become a defining feature of Sino-Japanese political-Economic Relations. This puzzling pattern of interaction is clearly illustrated in the sovereignty dispute over the Senkaku/Diaoyu Islands. The island dispute has unfolded in five rounds of distinct clashes thus far. From one perspective, the competitive elements in the island dispute make it difficult for both Japan and China to give way to the other side on the territorial and maritime issues. At the same time, the two countries have successfully managed to contain their respective territorial and maritime claims thus far. Drawing on the liberal peace theory, this article systematically demonstrates that Economic interdependence has repeatedly fostered the de-escalation of Sino-Japanese conflict over territorial and maritime rights.

  • The Financialization of the US Forest Products Industry: Socio-Economic Relations, Shareholder Value, and the Restructuring of an Industry

    This paper draws on theories of socio-Economic change stemming from political economy and Economic sociology to examine the financialization of the US forest products industry. I argue that the widespread adoption of shareholder value norms of corporate governance constitutes one of the core ideological foundations for explaining how the financialization of non-financial firms was accomplished. At the same time, I suggest that Economic sociologists’ emphasis on the role of shareholder value ideology tends to obscure the concrete realities of contemporary capitalism and the socio-Economic Relations that underlie managerial conceptions of control. In this paper, I adopt a dialectical methodology that works at multiple levels of abstraction in order to highlight the internal Relationship that exists between managerial conceptions of control and the material processes of capital accumulation. Using data mined from corporate proxy statements, I show that increases in concentrated stock ownership among institutional investors and the use of incentive-based compensation—among other important factors—underlie the adoption of shareholder value strategies in the US forest products sector. I then demonstrate how the pursuit of shareholder value reshaped the US forest products in the interests of the financial community while undermining long-term stability of the industry and the people who depend on it.
