    Abstract Particle size is a fundamental property of any sediment, soil or dust deposit which can provide important clues to nature and provenance. For Forensic Work, the particle size distribution of sometimes very small samples requires precise determination using a rapid and reliable method with a high resolution. The Coulter™ LS230 laser granulometer offers rapid and accurate sizing of particles in the range 0.04–2000 μm for a variety of sample types, including soils, unconsolidated sediments, dusts, powders and other particulate materials. Reliable results are possible for sample weights of just 50 mg. Discrimination between samples is performed on the basis of the shape of the particle size curves and statistical measures of the size distributions. In routine Forensic Work laser granulometry data can rarely be used in isolation and should be considered in combination with results from other techniques to reach an overall conclusion.

    The private Forensic Work discussed here is performed as an “expert” or “expert witness,” defined in law as a person who is allowed to offer opinions to a court. One should not be an expert in Forensic matters that involve one’s own patients. Initial communication with the potential retaining entity (e.g., lawyer, court, agency, insurance company) should clarify the case, the lack of conflict of interest, one’s possible Forensic role, and practicalities such as fees, scheduling, and the way in which the Work will be performed. One should guard against being misused, or having one’s opinions misconstrued, in Forensic matters, including being named as an expert witness without actually being retained (a “phantom expert”). Communicating orally with the retaining entity about progress and findings is important; written findings or opinions should be created or communicated only if the lawyer (or other retaining entity) requests them. Opinions should not be rendered without adequate review of complete and credible records and/or other sources, and even then caveats or disclaimers may be ethically or legally required. The Forensic Work routine almost always begins with record review, and may or may not include examining a litigant or other person.

    "Marketing" refers to the entire process of bringing a product or service to the public and creating a demand for it. It is not simply advertising. There are good and bad ways to market one's practice, and some that are distasteful or even unethical. The quality and credibility of your Work are your most important marketing tools. Reputation and word-of-mouth among attorneys is the largest referral source for most private Forensic practitioners. Your professional and business practices, the quality of your staff and their interactions with clients, and your day-to-day availability are all critical. The Internet is important for some practitioners. Practice websites are inexpensive, but they should be carefully constructed and avoid appearing sensational or overly self-serving. Research the basics of websites and website traffic, and don't expect great results for the first year or so. A Web consultant may be helpful, but avoid those who charge lots of money or make grand promises. Paying for advertisements, listings, or brochures is rarely fruitful. Your primary marketing targets are likely to be attorneys, but may include courts and certain government agencies; clinicians are not usually a major referral source. Patients and potential litigants themselves are off-limits; marketing to them is generally unethical.

    This month’s column is about maintaining a separation between some kinds of Forensic Work and providing general patient care for the same patient/evaluee. It has been a long time since I focused on this topic in this column,1 but the issue remains very relevant. In a perfect world, the multifaceted conflict of interest between objective Forensic Work and the obligations of a doctorpatient relationship would never occur. In the real world, however, such conflicts happen all the time, and while they are sometimes harmless, they can also create big problems. Note that I am not implying that “Forensic” practice doesn’t include clinical Work. There are many clinical aspects of Forensic Work, just as patient care has a number of points of interface with the legal system. The point of this column is recognizing potential conflicts and separating those that are manageable from those that are likely to interfere with both our duties and the fair outcome of legal or administrative procedures.

    There has been an exponential increase in litigation relating to birds and other exotic species over the past few years. Legal cases mainly concern such issues as provenance, aging and parentage, causes of death, and health and welfare. Protected species are often involved. Forensic veterinary medicine can be defined as the application of veterinary knowledge to the purpose of the law: it can also be relevant to insurance claims and allegations of professional misconduct. Certain aspects of Forensic Work are the responsibility of the specialist pathologist, toxicologist, or DNA technologist, but veterinary practitioners also need to have some familiarity with the subject. Important requirements summarized in this article and discussed in detail elsewhere in this issue are the use of standard techniques, meticulous investigations, proper labeling and storage of samples, and detailed record keeping. Forensic Work offers a challenge to practicing veterinarians and is particularly relevant to those who Work with exotic species.

Forensic veterinary medicine is as yet not a recognized discipline but is rapidly evolving. New challenges demand new approaches.

  • ISO Standards Addressing Issues of Bias and Impartiality in Forensic Work.

    The ISO/IEC 17020 and 17025 standards both include requirements for impartiality and the freedom from bias. Meeting these requirements for implicit cognitive bias is not a simple matter. In this article, we address these international standards, specifically focusing on evaluating and mitigating the risk to impartiality, and quality assurance checks, so as to meet accreditation program requirements. We cover their meaning to management as well as to practitioners, addressing how these issues of impartiality and bias relate to Forensic Work, and how one can effectively evaluate and mitigate those risks. We then elaborate on specific quality assurance policies and checks and identify when corrective action may be appropriate. These measures will not only serve to meet ISO/IEC 17020 and 17025 requirements, but also enhance Forensic Work and decision-making.

  • Cognitive neuroscience in Forensic science: understanding and utilizing the human element

    The human element plays a critical role in Forensic science. It is not limited only to issues relating to Forensic decision-making, such as bias, but also relates to most aspects of Forensic Work (some of which even take place before a crime is ever committed or long after the verification of the Forensic conclusion). In this paper, I explicate many aspects of Forensic Work that involve the human element and therefore show the relevance (and potential contribution) of cognitive neuroscience to Forensic science. The 10 aspects covered in this paper are proactive Forensic science, selection during recruitment, training, crime scene investigation, Forensic decision-making, verification and conflict resolution, reporting, the role of the Forensic examiner, presentation in court and judicial decisions. As the Forensic community is taking on the challenges introduced by the realization that the human element is critical for Forensic Work, new opportunities emerge that allow for considerable improvement and enhancement of the Forensic science endeavour.

  • Verifying the reliability of blood residue analysis on archaeological tools

    Abstract:

    Abstract An objective test of the validity of blood residue analysis as a technique for identifying archaeological tool use is presented. It is concluded that such residues do remain on tools for over 5600 years and that cross-over electrophoresis can accurately detect such residues. This technique provides an accurate means for identifying the animal species on which prehistoric tools were used. Routine museum curation procedures and normal soil processes do not necessarily destroy such residues. This test further supports the use of this technique for identification of unknown stains in Forensic Work.
