  • the international community and land rights for indigenous and Tribal Peoples
    Development, 1992
    Co-Authors: Roger Plant
    Abstract:

The networking activities and the intergovernmental organizations and nongovernmental organizations (NGOs) policy on indigenous people are described in terms of their impact on protection of land rights and indigenous people. There are a range of activities the international community is involved with in relating to indigenous populations indirectly or directly. The International Labor Organization was the first and is the only international agency which had international ratifiable standards for dealing with indigenous people. The World Bank which was a leader among lenders in establishing internal guidelines for safeguarding the land rights of indigenous populations the Inter-American Development Bank and the Asian Development Bank have established internal guidelines. The trend for intergovernmental agencies is to develop specific projects for the direct benefit of indigenous populations. Protection of land rights is a first step and needs to be followed with increases in productive activities and resources management and political will. The trend is also toward increased nongovernmental involvement with indigenous populations. Indigenous groups and advocacy groups for indigenous people have been formed to influence policy at the national and international levels. Some of the older more established advocacy groups are Survival International in London Cultural Survival in Boston and the International Work Group for Indigenous Affairs in (WRM) in Malaysia the World Resources Institute (WRI) and the Gaia Foundation in London. Human rights organizations and charitable organizations have played a role in addressing indigenous population issues. Examples are given for activities conducted by WRI Oxfam IIED the Wisconsin Land Tenure Center ODI Cultural Survival and WRM.

  • The Foundations of Modern International Law on Indigenous and Tribal Peoples
    2018
    Co-Authors: Lee Swepston
    Abstract:

The International Labour Organization is responsible for the only two international Conventions ever adopted for the protection of the rights and cultures of indigenous and Tribal Peoples. The Indigenous and Tribal Populations Convention, 1957 (No. 107) and the Indigenous and Tribal Peoples Convention, 1989 (No. 169) that revised and replaced Convention No. 107, are the only international Conventions ever adopted on the subject, and Convention No. 169 is the only one that can now be ratified. This volume, and its companion to be published at a later date, make clear that the basic concepts and the very vocabulary of international human rights on indigenous and Tribal Peoples derives from these two Conventions. The adoption in 2007 of the UN Declaration on the Rights Of Indigenous Peoples (UNDRIP), and the ongoing discussions in the international human rights community about the relative merits, impact and legal validity of the UN and ILO instruments, make it all the more important to understand how Convention 169 was adopted. The author of this unique study was responsible for many years for the supervision of both Conventions in the ILO’s supervisory machinery, and was intimately involved in the adoption of the 1989 instrument, as well as in international discussions on the subject of indigenous and Tribal Peoples.

  • Discrimination, Indigenous and Tribal Peoples, and Social Indicators
International Journal on Minority and Group Rights, 2011
    Co-Authors: Lee Swepston
    Abstract:

This article has two focuses. The first is on the subject of indicators, the collection of objective information to measure the socioeconomic and rights situation of indigenous Peoples. The international community has spent a good deal of time and effort exploring whether it is possible to construct indicators of performance on human rights, and on whether the indicators commonly used for assessing well-being for populations in general are well adapted to the situation of indigenous Peoples, and there is by now a consensus that generally-applicable indicators are not adequate to describe the situation of indigenous and Tribal Peoples. The problems with constructing such indicators, and the current state of discussion, are outlined. The other part of the article notes that indicators concerning indigenous Peoples are available in a certain number of countries. Even though they are not consistent between countries, and in some cases have not been collected long enough to demonstrate progress or the lack thereof, in every country where they are available they show that indigenous Peoples are at the bottom of virtually every social indicator – poverty, health, economic participation and other fields. This lack of protection is closely tied to discrimination.
